Common use of REQUIRED HEALTH EXAMINATIONS Clause in Contracts

REQUIRED HEALTH EXAMINATIONS. The Deputy Superintendent, Human 23 Resource Services, or his/her designee may require an employee to report for a health 24 examination when in his/her judgment it is apparent that the employee or the District may be 25 harmed if the condition/situation is allowed to continue. It is the District’s right to require a 26 medical examination of any employee by a physician of its choice at its discretion and 27 expense. If the report of the physician shows the employee is in an unfit condition to perform 28 regular duties, with or without reasonable accommodation, the employee may be required to 29 absent himself/herself by being placed on administrative leave not to exceed five (5) days 30 until a determination of leave status is made by Human Resource Services. If the health 31 examination is given other than during the employee's regular working hours, the employee 32 shall be granted time off equal to that required for the examination. Overtime provisions 33 shall apply. The maximum time creditable for an examination shall be two (2) hours. 34
