Common use of Required Meetings or Hearings Clause in Contracts

Required Meetings or Hearings. Whenever any administrator is required to appear before the Superintendent or his designee, or the Board, or any committee, Representative or agent thereof, concerning the continuation of that administrator in his office, position or employment, or the salary or any increments pertaining thereto, then he shall be given prior written notice of the reason for such meeting or interview and shall be entitled to have a representative present to advise him and represent him during such meeting or interview.

Whenever any administrator Administrator is required to appear before the Superintendent or his designeeany Administrator, or the BoardSupervisor, Board of Education or any committeecommittee member, Representative representative or agent thereof, thereof concerning any matter which could adversely affect the continuation of that administrator Administrator in his his/her office, position or employment, employment or the salary or of any increments pertaining thereto, then she/he shall be given prior written notice of the reason reasons for such meeting or interview and shall be entitled to have a representative representative(s) of the Association present to advise him and represent him him/her during such meeting or interview. This provision shall not apply to observation or evaluation conferences.

It is understood that the Administrator shall provide the Superintendent with reasonable notice of an Association representative’s attendance at such meeting.

Whenever any administrator is required to appear before the Superintendent or his designee, or the Board, Commission or any committee, Representative or agent thereof, committee thereof concerning any matter of discipline which could adversely affect the continuation of that administrator in his his/her office, position or employment, or the salary or any increments pertaining thereto, then he he/she shall be given prior written notice of the reason reasons for such meeting or interview and shall be entitled to have a representative of the Association present to advise him him/her and to represent him him/her during such meeting or interviewmeeting.

Whenever any administrator is required to appear before the Superintendent or his designeeSuperintendent, or the Board, or any committee, Representative committee or agent thereof, member thereof concerning any matter that could result in the continuation termination of employment of that administrator in his officeadministrator, position or employment, or the salary or any increments pertaining thereto, then he shall be given prior notice (which will be in written notice form) of the reason reasons for such meeting or interview interview, and if desired, shall be entitled to have a representative representative(s) of the Association and/or attorney present to advise him and represent him during such meeting or interview. The Association shall have the right to be present to protect the interests, not only of the individual involved but also of the organization as the bargaining representative exclusively recognized.
