Research Agreement. This Agreement supersedes the Research Agreement with respect to any subject matter addressed herein or any inconsistency.

Research Agreement. After approval of a research request, but prior to the commencement of the project, the ICC shall enter into an agreement with the sponsoring institution and/or researcher, which sets forth each party's obligations and complies with HIPAA, HITECH and all applicable state and federal privacy and security laws and regulations. The agreement may take the form of a Limited Data Set Agreement or a Data Use Agreement. No ICC employee shall participate in and no ICC data shall be released for a research project until authorized representatives of the ICC and the institution and/or researcher have signed an agreement. Each agreement shall include a provision that permits the ICC Executive Director or the Board to suspend or terminate the ICC's participation in any Project based upon concerns regarding the manner in which the project is being conducted. At all times, the protection of PHI in compliance with HIPAA, HITECH and all other federal and state privacy and security laws and regulations shall remain the priority of the ICC.
