Resignation and liquidated damages. 1. If an employee’s resignation is submitted between the statutory deadline for resignations set forth in K.S.A. 72-5437 and June 30th, a $500 penalty will be assessed; between July 1st and July 31st, a $1,000 penalty will be assessed; between August 1st and August 15th, a $2,000 penalty will be assessed; and after August 15th a $4,000 penalty will be assessed. Upon receipt of the appropriate fee, the Board will accept the employee's resignation. 2. The penalties outlined in section A will be waived by the Board if one of the following situations caused the employee’s resignation: a. Relocation of the employee’s spouse’s job, b. Illness of an employee or employee’s immediate family member, c. Death of an employee’s immediate family member, d. Reassignment to a different school district that occurs after the statutory deadline for resignations, or e. Any other circumstance that the Board may deem appropriate.

Resignation and liquidated damages. A certified employee, who has signed a contract and accepted a teaching position in the district for the coming year or has not resigned by the continuing contract notice deadline date, shall not be released from that contract to accept another position until a competent replacement has been contracted. The Board will consider the resignation of any employee which is submitted to the Board in writing. The Board will accept such resignations only when the Board is of the opinion that such resignation will be in the best interest of the district. The protection of public interest is a proper consideration in the determination of the possibility of liquidated damages. In the event any certified employee resigns or fails to honor the terms of the employment contract, the certified employee shall pay to the district liquidated damages as follows: If the certified employee resigns or fails to honor the terms of the contract between June 1 and June 15, the liquidated damages shall be $500. If the certified employee resigns or fails to honor the terms of the contract between June 16 and June 30, the liquidated damages shall be $1500. If the certified employee resigns or fails to honor the terms of the contract on or after July 1, the liquidated damages shall be $2000. In the event the district owes the certified employee additional salary amounts after the certified employee resigns or fails to honor the contract, the Board may deduct the amount of liquidated damages from the amount owed to the certified employee by the district. In the event the certified employee terminated employment in the district without compliance with board policy, the Board will request that the Professional Practices Commission review the case.

The remedies provided in this Section 9.2 will not be exclusive of or limit any other remedies that may be available to Buyer or the other Indemnified Persons.

  • Computation and Payment of Fee The advisory fee shall accrue on each calendar day, and shall be payable monthly on the first business day of the next succeeding calendar month.   • Indemnification and Reimbursement of Payments on Behalf of Executive The Company, Employer and their respective Subsidiaries shall be entitled to deduct or withhold from any amounts owing from the Company or any of its Subsidiaries to Executive any federal, state, local or foreign withholding taxes, excise taxes, or employment taxes (“Taxes”) imposed with respect to Executive’s compensation or other payments from the Company or any of its Subsidiaries or Executive’s ownership interest in the Company, including, without limitation, wages, bonuses, dividends, the receipt or exercise of equity options and/or the receipt or vesting of restricted equity. In the event the Company or its Subsidiaries does not make such deductions or withholdings, Executive shall indemnify the Company and its Subsidiaries for any amounts paid with respect to any such Taxes, together with any interest, penalties and related expenses thereto.

  • Termination and Resignation of Agent (a) The Agent may be terminated at any time upon ten (10) days prior written notice from the Senior Noteholder. In the event that the Agent is terminated pursuant to this Section 30, all of its rights and obligations under this Agreement shall be terminated, other than any rights or obligations that accrued prior to the date of such termination.   • Termination and Severance Pay A. In the event Employee is terminated by the Board before the expiration of the term of this agreement without just cause, and during that time Employee is willing and able to perform his duties under this Agreement, the Board shall continue to pay Employee's salary for a period of four (4) months after the date of termination (the "Severance Period") and shall continue Employee's then current health insurance coverage for a period of four (4) months. In the event Employer is not able to maintain Employee's health insurance coverage pursuant to the terms of the Township health insurance plan, then Employer shall pay to Employee, for a period of four (4) months, the cost of health insurance premiums at a rate that will continue substantially similar health benefits for Employee and Employee's family, if applicable, as provided under the then current township health insurance plan. In addition, the Board shall pay the cash value of any accrued vacation time. All of the above shall hereinafter be referred to as the Severance Compensation. The parties agree that this Severance Compensation shall constitute Employee's sole and exclusive remedy for termination without just cause B. In the event Employee is terminated by the Board before the expiration of the term of this agreement with just cause, the Board shall have no obligation to pay the Severance Compensation set forth in Section 3A. For the purposes of this paragraph, the Board's failure to grant Employee a raise equivalent to that given any or all other Township Employees shall not be deemed a "reduction" as provided herein. D. In the event Employee desires to voluntarily resign his position with the Board before the expiration of the above term of this employment, then Employee shall give the Board thirty (30) days notice in advance, unless the parties agree otherwise in writing. In the event the Employee voluntarily resigns his position, he shall not be entitled to the severance pay provisions contained in Section 3A hereof. E. For the purposes of Section 3. hereof, "just cause" shall mean the following: (a) The Employee is convicted of a felony; (b) The Employee has failed or neglected to carry out his duties hereunder in any material and significant respect, or has been guilty of misfeasance, malfeasance, or nonfeasance in office for a period of thirty (30) days after written notice to him from the Board specifying the nature of such failure, neglect, misfeasance, malfeasance, or nonfeasance in office, unless such misfeasance, malfeasance, or nonfeasance is so egregious or of such a nature that it is of a criminal nature or it cannot be corrected. F. If the Employee is permanently disabled or is otherwise unable to perform his duties because of sickness, accident, injury, mental incapacity or health for a period of eight successive weeks beyond any accrued sick leave and vacation time, the Board shall have the option to terminate this Agreement, and Employee shall receive the Severance Compensation set forth under Paragraph 3A. above.

  • Termination and Resignation Your services as a Director may be terminated for any or no reason by the determination of the Board. You may also terminate your services as a Director for any or no reason by delivering your written notice of resignation to the Company (“Resignation”), and such Resignation shall be effective upon the time specified therein or, if no time is specified, upon receipt of the notice of resignation by the Company. Upon the effective date of the termination or Resignation, your right to compensation hereunder will terminate subject to the Company's obligations to pay you any compensation that you have already earned and to reimburse you for approved expenses already incurred in connection with your performance of your Duties as of the effective date of such termination or Resignation.
