Common use of Retaining Qualified/Certified Seniority Clause in Contracts

Retaining Qualified/Certified Seniority. A person who has been laid off retains his/her qualified seniority until offered re- employment in the area in which he/she is certified and qualified at the time of layoff. If the certification and qualification of a non-probationary teacher with more than five (5) years of experience changes during layoff due to additional course work taken, he/she will be offered the next open position for this area of certification and qualification. No teacher will be asked to submit a letter of resignation during the layoff period.
