Common use of Return to Former Job Clause in Contracts

Return to Former Job. (a) In the event that an employee is promoted in accordance with the provisions of this Article and within thirty (30) days of such promotion he is not performing efficiently, or the employee wishes to do so, he will revert to his immediate previous job, without loss of seniority. (b) If additional people are required, they will be drawn from the previous posting, provided, however, there are enough applicants on the previous posting to fill the vacancy.

Return to Former Job. (b) In the case of temporary employees, they will return to the status of temporary employee and will suffer no loss of accumulated hours as a result of the change. If additional people employees are required, they will be drawn from the previous posting, provided, however, there are enough applicants on the previous posting to fill the vacancy.

(b) If additional people are required, they will be drawn from the previous posting, provided, however, there are enough qualified applicants on the previous posting to fill the vacancy.
