RECOGNITION & SCOPE. 1.1 The Employer recognizes the Union as the sole and exclusive bargaining agent for all employees of the Employer, including part-time, casual and temporary employees in accordance with the decision of the Ontario Labour Relations Board dated January 11, 2001, and the terms of the Memorandum of Agreement between the Ottawa Transition Board and all predecessor bargaining agents dated October 18, 2000, regarding bargaining unit scope. See Appendix A.
RECOGNITION & SCOPE. 2.01 The University recognizes the Union as the exclusive bargaining agent for all employees of Queen’s University in the City of Kingston who hold a general staff appointment save and except:
(a) persons employed at salary grades 10 and above;
(b) persons who exercise managerial functions or who are employed in a confidential capacity in matters relating to labour relations within the meaning of section 1(3)(b) of the Ontario Labour Relations Act, 1995;
i. The parties agree that the following persons shall be deemed to be employed in a confidential capacity in matters relating to labour relations within the meaning of 1(3)(b) of the Ontario Labour Relations Act, 1995: • persons employed in the Human Resources Department; • persons employed in the Principal’s Office;
ii. For clarity, it is understood and agreed that the persons employed in the following offices are persons employed within the meaning of section 1(3)(b) of the Ontario Labour Relations Act, 1995: • the Xxxxxxx and Vice-Principal (Academic)’s Office; • the Deputy Xxxxxxx’x Office; • the Office of the Vice Principal (Finance and Administration); • the Human Rights Office; • the Equity Office; • the Office of the University Secretariat; • the Office of Institutional Research and Planning; • the Office of the Internal Auditor; • the Office of Faculty Relations; and, • University Relations (Communications)
iii. The University will not add positions to the Offices/Units referenced in Article 2.01(b)

RECOGNITION & SCOPE. 2.01 Garda Security Group Incorporation (hereinafter “the Employer”) recognizes the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International union (United Steelworker) (hereinafter “the Union”) as the exclusive bargaining agent for all employees in the Province of Ontario save and except:
a) Supervisors and persons above the rank of Supervisor;
b) Client Service Representatives;
c) Private Investigators licensed as such pursuant to the laws Of Ontario;
d) Office, clerical and sales staff;
e) All employees represented as of the date of this Collective Agreement by the United Food and Commercial Workers International Union (hereinafter “the UFCW”) pursuant to a Valid current collective agreement with the Employer;
(a) The parties agree that "supervisor" is deemed to include Site Supervisor, Shift Supervisor, Mobile Patrol Supervisors, Field Supervisors, Dispatcher and other persons who exercise managerial functions within the meaning of section 1(3) of the Labour Relations Act, R.S.O. 1990, c. L.2, as amended.
(b) Positions created by the employer, shall automatically be included be in the bargaining unit unless specifically excluded pursuant to Article 2.01. a, b, c, d and e.
2.03 The parties agree that only employees who are in the bargaining unit will perform bargaining unit work except:
a) as otherwise provided in this Agreement;
b) for the purpose of instruction; and/or
c) as an ancillary part of their function, security guard work only:
i) at sites at which only patrol and inspection checks are required;
ii) in cases of emergency, such as flood or fire or another similar reason: or
iii) in other circumstances for not more than three (3) consecutive hours or ending as soon as possible thereafter.
2.04 Notwithstanding articles 2.02 and 2.03, persons designated as a supervisor by the employer shall be excluded from the bargaining unit and shall be entitled to perform such bargaining unit work as is necessary, provided that:
(a) in the case of security officers, the number of supervisors assigned to any site (which may include a number of posts) shall be in proportion to the number of hours regularly worked at the site and shall not exceed the number as set out in the following table. Column (a) of the table sets out the number of supervisors for sites which were obtained prior to [the date of ratification of the 2011 agreement] only. RECOGNITION & SCOPE. 2.01 The Employer recognizes the Union as the sole and exclusive bargaining agent for all employees employed by GrowthWorks Capital Ltd., except those excluded by the Certification.
2.02 Persons, whether employed by the Employer or from outside who are not members of the bargaining unit, will not perform work on any jobs which are included in the bargaining unit, except as follows:
a) for the purpose of instruction,
b) in the case of an emergency when bargaining unit Employees are not available.
2.03 Should any of the present operations be moved to a location(s) outside of the boundaries of the Vancouver site this Agreement shall be extended to cover such location(s).
2.04 Any rights and privileges enjoyed by an Employee prior to the execution of this Agreement will be continued and will not be changed during the life of this Agreement provided:
a) such rights and privileges are not in conflict with any provisions of this Agreement, and/or;
b) such rights and privileges are not changed by the effect of this Agreement.
RECOGNITION & SCOPE. 3.01 The Employer recognizes the Union as the sole and exclusive bargaining agent for all Stagehands employed by Xxxxx University in the Niagara Region and the City of Xxxxxxxx in the Province of Ontario, save and except supervisors and those above the rank of supervisor and those already covered by a pre-existing collective agreement. For the purpose of clarity, the parties agree that Stagehands include the positions of Technical Director, Theatre Technical Production Assistant, Theatre Technicians, Production Runner, and students hired as casual helpers commonly referred to as “Stagehands” and “Wardrobe Assistants”. For further clarity, the parties agree that the position of Head of Wardrobe is included in this Union as defined in Article 1.01.
3.02 Supervisory personnel and employees not covered by the terms of this Agreement shall not work on any jobs which are normally done by employees covered by this Agreement except for the purposes of instruction, experimentation, and emergencies. Notwithstanding the foregoing, in the event of an emergency the employer will make all reasonable efforts to ensure that Bargaining Unit work shall be performed by members of the Bargaining Unit as defined in Article 3.01.
RECOGNITION & SCOPE. 2.01 The Employer recognizes the Union as the sole and exclusive bargaining agent for its employees in the City of Toronto, save and except supervisors, persons above the rank of supervisor, members of the academic staff, professional librarians, Human Resources Officer, Executive Assistant to the Bursar, Executive Assistant to the President, Payroll Accountant, Administrative Assistant to the Director, Continuing Education, Executive Assistant to the Praeses, PIMS, Executive Assistant to Principal, Executive Assistant to Xxxx of Theology, persons regularly employed for not more than twenty-four hours per week and students employed during the school vacation period.
2.02 No employee who has successfully completed their probationary period will be laid off from the bargaining unit as a direct result of contracting out.
2.03 Where short-term staffing shortages (e.g., sick leave/LTD, leaves of absence) in the bargaining unit result in the employer bringing in a contractor, the employer will inform the Union and indicate the anticipated duration.

Xxxxxxx Xxxxxx, 0000 Xxx Xxxxx Road in the Municipality of Metropolitan Toronto and 0 Xxxxxxxxx Xxxxxx in the City of Scarborough, save and except employees in bargaining units for which any trade union held bargaining rights prior to the date hereof, Supervisors or their designates, Guard Inspectors or their designates, persons above the rank of Supervisor or their designate, Guard Inspector or their designate, and office, clerical and sales staff.
RECOGNITION & SCOPE. The Board of Education of Millburn Community Consolidated School District #24, Lake County, Illinois (hereafter referred to as the “Board”) recognizes the Millburn PSRP, Lake County Federation of Teachers, Local 504, IFT-AFT/AFL-CIO (hereafter referred to as the “Union”), as the sole and exclusive bargaining representative for all regularly employed full-time and part- time paraprofessionals (teachers’ aides, classroom assistants, library clerks, before/after school club counselors and site supervisors) and maintenance/custodial/grounds staff, but excluding bus drivers, bus aides, occupational therapists, registered nurses, health clerks, lunchroom supervisors, administrative assistants, payroll clerk, bookkeeper clerk, technology support, Before/After School Club Program Coordinator, Network Administrator, Director of Building and Grounds, and all other managerial, supervisory, confidential and short-term employees as defined in the Illinois Educational Labor Relations Act.
RECOGNITION & SCOPE. The Company recognizes the Union as the sole bargaining agent for all dependant Operators who have executed a Company Operations Agreement, within the Province of British Columbia. Operators are defined as dependant Owner/Operators owning or renting the distribution rights to a sales territory in accordance with the Operations Agreement and do not include their employees (if any). This Addendum is not intended to apply to independent operators and customers or to force distributors to become members of the bargaining unit.
