Right to Counsel and Grieve. The Union and/or an employee, with or without the Union, shall have the right to file a grievance concerning any testing permitted by this Agreement, in which the basis for the testing, the administration of the test, the accuracy of the tests, the results of such tests, and/or other alleged violations of this Agreement. Any employee who is ordered to submit to testing shall have the right to contact a Union representative and/or lawyer at the time such order is given. However, such right shall not be cause for delay of testing of more than one (1) hour.
