Common use of Right to Have a Xxxxxxx Present Clause in Contracts

Right to Have a Xxxxxxx Present. An employee shall have a xxxxxxx or Union Representative present at any discussion with supervisory personnel, which the employee believes, might be the basis of disciplinary action. Where a supervisor intends to interview the employee for disciplinary purposes, the supervisor shall so notify the employee in advance of the purpose of the interview in order that the employee may contact a xxxxxxx or Union Representative to be present at the interview. No employee is required to answer to the charges without a Union Representative present. The employee reserves the right to waive the right to have a xxxxxxx or Union Representative present, and such waiver shall be in writing and signed by the employee in the presence of a Union Representative and an employer's representative. If disciplinary action results from any meeting with supervisory personnel without a xxxxxxx or Union representative present or a signed waiver, it shall be void. A xxxxxxx or local union officer shall have the right to consult with a C.U.P.E. staff representative and to have them present at any discussion with supervisory personnel, which might be the basis of discipline.
