A written description of the rights and duties of unit members with respect to student discipline shall be provided to unit members at the beginning of each school year. In addition, said written descriptions shall be available at each school site. The District shall not take action against a unit member who uses reasonable and lawful force in the performance of his/her duties. Unit members shall report any physical assault against the unit member to the principal or site administrator, who shall report the incident to the appropriate law enforcement agency. 8.7 During conditions of excessive heat, the Superintendent or designee, whenever appropriate, will reduce the school day for students in schools with non-operable air conditioning, to the State required minimum day. Unit members may be directed to proceed to a district air conditioned location for the remainder of the service day. The Superintendent or designee shall have the discretion to reduce the school day to the State required minimum day whenever other weather conditions pose a danger to students and unit members. Unit members may be directed to proceed to another District location for the remainder of the service day. 8.8 For protection of unit members whose normal duties may require transportation of students in unit member's vehicles, the District shall provide secondary insurance against personal liability for damages for death, injury to a person, or damage or loss of property caused by the negligent act or omission of the unit member when acting within the scope of his/her employment. Additionally, the District will provide this same coverage to unit members who are required to travel from site-to- site or make home visitations in order to perform assigned duties. When a loss occurs, the unit member's primary insurance deductible will be reimbursed up to a maximum of $500.00. If administrator approval is unobtainable, the teacher's best judgment for the protection of student safety shall be included in the above. 8.9 Restrooms shall be available to unit members whenever they are required to render service. 8.10 Adequate lounge facilities shall be provided for unit members' use. Additionally, the District shall provide, when fiscally possible, at least one piece of furniture per site where a staff member may recline. The site safety committee shall determine the placement of these facilities and furniture. 8.11 Unit members shall have the right to refer to the office, a student who exhibits symptoms of illness which endanger the health of other students or the unit member. The student shall not return to the classroom until it is determined by the principal/site administrator that his/her health is not a clear and present danger to those with whom he/she shares space. The student shall be given a pass to return to class signed by the principal/site administrator confirming the decision. 8.12 The District shall reimburse or repair articles of clothing, glasses and hearing aids damaged while the unit member is acting in the proper discharge of disciplinary/ supervisorial duties. In addition, all other accessories damaged under the conditions listed above shall be reimbursed up to a maximum of $200.00.

These rules of student conduct shall be revised as necessary and shall undergo the site-level review and modification/adoption process pursuant to Board Policy at least every four years. C. When in the judgment of a bargaining unit member a student requires the attention of the principal, assistant principal, xxxx, counselor, psychologist, physician, or other specialist because the student's presence in the classroom is a threat to the safety of the bargaining unit member, bargaining unit member shall so inform their principal or delegated specialist. The principal or delegated specialist shall make a reasonable attempt to arrange as soon as possible for a conference between the bargaining unit member and the appropriate parties to discuss the problem and decide on the appropriate steps for its resolution. A written report on the disposition of the case shall be provided to the bargaining unit member as soon as possible. The District shall abide by Education Code 49079. Teachers will be notified of pupils whose actions are grounds for suspensions or expulsions. The District shall provide the information to the teachers based upon any records that the District maintains in its ordinary course of business, or receives from a law enforcement agency, regarding a pupil described in the section. Procedures specifying how teachers will be notified of dangerous pupils shall be included in each school's safety plan. D. The District shall not take any action against a bargaining unit member who uses reasonable and lawful force in the performance of his/her duties. Unit members shall report any physical assault against the duties unless and until such bargaining unit member is found guilty of having committed a misdemeanor and/or felony as the result of having used force. (See Ed Code 49001) E. The Board shall maintain within the course of this Agreement a liability policy with a qualified insurer. See Appendix B. F. The District shall comply with all applicable health and safety laws. This section is grievable, and appealable to the principal Board or site administratorto whatever forum is provided in the law. To receive reimbursement for stolen equipment, the bargaining unit member must submit a clear and present danger to those with whom he/she shares space. The student shall be given a pass to return to class signed by police report certifying the principal/site administrator confirming the decisionbreak-in or vandalism. 8.12 N. The District shall reimburse bargaining unit members from loss of or repair articles damage to personal property while acting to quell a disturbance or as a result of clothing, glasses and hearing aids damaged while the unit member is acting in the proper discharge being a victim of disciplinary/ supervisorial dutiesan assault/battery. In addition, all other accessories damaged under the conditions listed above Reimbursement shall be reimbursed up limited to a maximum $500.00. The student amount of reimbursement shall not return to be less than $25 nor more than $200 and does not exceed the classroom until it is determined by actual value of the principal/site administrator that his/her health is not a clear and present danger to those with whom he/she shares spaceproperty at the time of loss; 13. A Unit members may use reasonable force under circumstances which require that they defend themselves or students against an assault; provided, however, that such force does not exceed that which is needed to repel or protect from bodily injury and provided further, that the unit member report any such incident to the immediate supervisor within a twenty-four (24) hour period. The above provision shall not be required read as a requirement that unit members must place themselves in danger of serious bodily injury in order to perform duties under conditions which endanger his/her health protect another employee or safetystudent from an assault. Nothing contained in this Agreement shall be deemed as waiving the statutory rights of a unit member to suspend a student. PERSONAL PROPERTY REIMBURSEMENT: Personal property brought to the work site by unit members and used as an integral part of and necessary to the educational program shall be reimbursed for loss, destruction or damage by arson, theft or vandalism. Property must be approved in advance for use in school by the Principal or designee who shall confirm the reimbursement value in writing. 8.2 The (a) Any device used to support school safety (including, but not limited to, those equipped with apps such as Catapult) will have implicit approval not requiring additional written approval. Said devices will be registered with the Principal or designee. If a member’s registered device is damaged or stolen while on school grounds, District shall make a good faith effort to reduce or alleviate those conditions which cause stress. The reduction of threats or intimidation by students or other members will compensate the member the replacement cost of the public device at the time of loss. (b) Reasonable care shall be a continuous effort of both the District and taken by unit members working togetheradequately to protect such property while it is on school property. SAFETY CONDITIONS. 8.1 The A. With the exception of eyeglasses, contact lenses, hearing aides, dentures, watches or clothing necessarily carried or worn by a unit member in the line of duty, personal property must be educationally relevant and may be used at the work site only with the prior written approval of the immediate supervisor. Written approval must be renewed annually. 2. The loss, destruction or damage to personal property was the result of malicious acts of another person such as arson, burglary, vandalism, assault, etc. and cannot be wholly or partially attributable to the negligence of the unit member in providing adequate care, custody or security for the property; 3. All such property must have a value agreed upon by the unit member and the immediate supervisor; 6. All such personal property is expected to be removed from the workplace during summer, winter, spring or off-track breaks unless the unit member receives permission from the immediate supervisor for the property to remain at the workplace during the break; 7. The immediate supervisor must have reasonable cause to believe that the property loss, damage or destruction occurred on District premises or in the line of duty; 8. Any reimbursement the District provides for the loss, damage or destruction of personal property will be applied to the verified amount not covered by the unit member’s personal property loss insurance. 9. Loss, damage or destruction to personal vehicles is subject to reimbursement only if the loss occurred while parked in an employee parking lot or other designated area during the unit member’s attendance is required; 10. Reimbursement shall not include any contents of a vehicle which are not attached to the vehicle (e.g., camera, jewelry); 11. Personnel property loss, damage or destruction shall not be reimbursed for vehicular collision. 12. The amount of reimbursement shall not be less than $25 nor more than $200 and does not exceed the actual value of the property at the time of loss; 13. For any video security camera utilized on any/all District sites throughout the District which may record bargaining unit employees’ work during work hours, the following applies. 1. It is understood that the purpose of video cameras is to provide a school environment that promotes safety of students, employees and visitors on school grounds and will protect district property, facilities, and equipment from vandalism and theft. 2. Except as provided for herein, video camera images will not ordinarily be used to monitor District employees as a means to evaluate employees’ performance or efficiency. However, the District may use evidence derived from video camera information in disciplinary matters involving theft, destruction, misuse or misappropriation of District property or misconduct endangering the health and safety of students, District personnel and members of the public, or other serious acts of misconduct. 3. When in the judgment of a bargaining unit member a student requires the attention of the principal, assistant principal, xxxx, counselor, psychologist, physician, or other specialist because the student’s presence in the classroom is a threat to the safety of the bargaining unit member, bargaining unit member shall so inform his principal or delegated specialist. The principal or delegated specialist shall make a reasonable attempt to arrange as soon as possible for a conference between the bargaining unit member and the appropriate parties to discuss the problem and decide on the appropriate steps for its resolution. A written report on the disposition of the case shall be provided the bargaining unit member as soon as possible. The District shall abide by Education Code 49079. Teachers will be notified of pupils whose actions are grounds for suspensions or expulsions. The District shall provide the information to the teachers based upon any records that the Districts maintains in its ordinary course of business, or receives from a law enforcement agency, regarding a pupil described in the section. Procedures specifying how teachers will be notified of dangerous pupils shall be included in each school’s safety plan. D. The District shall not take any action against a bargaining unit member who uses reasonable and lawful force in the performance of duties unless and until such bargaining unit member is found guilty of having committed a misdemeanor and/or felony as the result of having used force. (See Ed Code 49001) E. The Board shall maintain within the course of this Agreement a liability policy with a qualified insurer. See Appendix B. F. The offending student will be removed from the Superintendent classroom to an administrator's care until the student's return to class has been recommended and agreed upon by the administrator and the assaulted unit member. 2. The District shall provide to any unit member who suffers bodily harm by an individual or designeegroup while carrying out his/her assigned duties, whenever appropriate, reasonable cooperation in the identification of any alleged assailant/s and/or witness/es and in securing any physical evidence required by the unit member for preparation of a law suit against the assailant/s. SAFETY CONDITIONS. 8.1 A. When a unit member is assaulted by a student, in connection with their assigned duties, and within their course of employment, the assault shall be reported to the principal, administrative designee or other immediate supervisor within a 24-hour period. The District unit member shall make every effort also fill out the appropriate incident report. The school/work site administrator shall hold a meeting before the student is returned to provide the classroom to discuss options and create a place plan to move forward with necessary staff in attendance. If the assault involves a student with a 504 plan or IEP, staff will adhere to mandates outlined by federal and state laws. 1. When in the judgment of a bargaining unit member a student requires the attention of the principal, assistant principal, xxxx, counselor, psychologist, physician, or other specialist because the student's presence in the classroom is a threat to the safety of the bargaining unit member, bargaining unit member shall so inform their principal or delegated specialist. The principal or delegated specialist shall make a reasonable attempt to arrange as soon as possible for a conference between the bargaining unit member and the appropriate parties to discuss the problem and decide on the appropriate steps for its resolution. A written report on the disposition of the case shall be provided to the bargaining unit member as soon as possible. The District shall abide by Education Code 49079. Teachers will be notified of pupils whose actions are grounds for suspensions or expulsions. The District shall not take action against a unit member who uses reasonable and lawful force in the performance of his/her duties2. Unit members shall report any physical assault against the unit member to the principal or site administrator, who shall report the incident to the appropriate law enforcement agency. 8.7 During conditions of excessive heat, the Superintendent or designee, whenever appropriate, will reduce the school day for students in schools with non-operable air conditioning, to the State required minimum day. Unit members may be directed to proceed to a district air conditioned location for the remainder of the service day. The Superintendent or designee shall have the discretion to reduce the school day to the State required minimum day whenever other weather conditions pose a danger to students and unit members. Unit members may be directed to proceed to another District location for the remainder of the service day. 8.8 For protection of unit members whose normal duties may require transportation of students in unit member's vehicles, the District shall provide secondary insurance against personal liability for damages for death, injury to a person, or damage or loss of property caused by the negligent act or omission of the unit member when acting within the scope of his/her employment. Additionally, the District will provide this same coverage to unit members who are required to travel from site-to- site or make home visitations in order to perform assigned duties. When a loss occurs, the unit member's primary insurance deductible will be reimbursed up to a maximum of $500.00. If administrator approval is unobtainable, the teacher's best judgment for the protection of student safety shall be included in the above. 8.9 Restrooms shall be available to unit members whenever they are required to render service. 8.10 Adequate lounge facilities shall be provided for unit members' use. Additionally, the District shall provide, when fiscally possible, at least one piece of furniture per site where a staff member may recline. The site safety committee shall determine the placement of these facilities and furniture. 8.11 Unit members shall have the right to refer request the Immediate Supervisor to correct any unsafe working condition. Should the officeImmediate Supervisor fail to do so within a reasonable time, a student who exhibits symptoms of illness which endanger the health of other students or the unit member. The student shall not return to the classroom until it is determined by the principal/site administrator that his/her health is not a clear and present danger to those with whom he/she shares space. The student shall be given a pass to return to class signed by the principal/site administrator confirming the decision. 8.12 The District shall reimburse or repair articles of clothing, glasses and hearing aids damaged while the unit member is acting shall also have the right to report unsafe working conditions to the California Occupational Safety and Health Agency. C. Unit members shall dress in a safe and professional manner consistent with good common sense. The site administrator shall hold an informal conference with the proper discharge unit member in cases of disciplinary/ supervisorial duties. In addition, all other accessories damaged under the conditions listed above shall be reimbursed up to a maximum of $200.00dispute.
