Common use of Salary Savings Leave Clause in Contracts

Salary Savings Leave. An ASF Member may request unpaid salary savings leave. At the discretion of the President/designee, an ASF Member may be allowed to take such unpaid leave if the President/designee determines that the following conditions exist: 1) an existing or projected budget deficit exists; 2) granting an unpaid leave of absence would help alleviate the projected budget deficit and /or mitigate layoffs; 3) staffing needs can continue to be met; and 4) other unpaid leaves of absence are not applicable to the situation. ASF Members taking leave under this Section will continue to accrue vacation and sick leave and be eligible for paid holidays and insurance benefits as if the ASF Member had been actually employed during the time of leave. If the unpaid leave of absence is for one (1) full pay period or longer, any holiday pay shall be included in the first payroll period warrant after return from leave of absence. Unpaid leave under this provision will be taken in full day increments not to exceed forty (40) work days per fiscal year. The discretionary function of the Employer under this Section is not subject to the grievance procedure.
