Sale and Purchase Obligation. During the Term and subject to the provisions of this PPA, Seller shall sell and deliver or cause to be delivered, and Buyer shall purchase and receive or cause to be received, one hundred percent (100%) of the Solar Products generated by the Facility up to the Nameplate Capacity. Buyer is not obligated to purchase Solar Products from any replacement facility or Solar Products delivered to any point other than the Delivery Point. Buyer shall have the right to resell the Solar Products. If and to the extent that Buyer requests the Facility to provide Ancillary Services within its capability, Buyer and Seller acknowledge and agree that such provision of Ancillary Services may result in a reduction of the amount of other Solar Products generated by the Facility. Seller shall not receive reimbursement or any other compensation for such reduction.

Sale and Purchase Obligation. Seller agrees to provide to Buyer, and Buyer agrees to purchase from Seller, RECs according to the terms of this Agreement and each Confirmation Letter now or hereafter entered into between the Parties.

Sale and Purchase Obligation. Xxxxxx agrees to provide and Xxxxx agrees to purchase RECs according to the terms of this Agreement and any Confirmation Letters now or hereafter entered into between the Parties.
Sale and Purchase Obligation. Seller agrees to sell or cause to be sold and Buyer agrees to purchase, for the price and upon the terms and conditions hereinafter provided, the assets, properties and business of Seller described below and all goodwill associated therewith (all of which assets to be acquired being hereinafter collectively referred to as the “Assets”) excluding, however, the assets specified in Section 2. Sale and Purchase Obligation. 2.1. Unless performance is excused due to the occurrence of events of Force Majeure as described in Article XI hereof, Seller shall make available for delivery to Buyer on each Day at the Delivery Point(s), the volume nominated by Buyer pursuant to Section 2.2 hereof up to twice the Daily Contract Demand Volume.
Sale and Purchase Obligation. Seller shall mine, manufacture and sell to Purchaser, and Purchaser shall purchase and accept from Seller, the Coal in quantities constituting one hundred percent (100%) of Purchaser's requirements, subject to Schedule A, Terms and Conditions of the agreement, of coal during the Term. The size, quantities, quality and specifications of such coal shall be as provided on Schedule C and incorporated herein by reference.
