Sales Milestone. Novartis shall make a one-time payment to Infinity of $[**] upon the first achievement of Annual Net Sales of a Licensed Product exceeding $[**]. For the avoidance of doubt, this milestone shall be payable only once, even if other Licensed Products achieve Annual Net Sales exceeding $[**].
Sales Milestone. Celgene shall make the following non-refundable, non-creditable, one-time payment to Agios (i) with respect to each Co-Commercialized Product or Split Product within [**] days following the first achievement of aggregate Annual Net Sales in the [**] of each such Licensed Product that meet or exceed the threshold set forth below, and (ii) with respect to each Picked Product, within [**] days following the first achievement of aggregate [**] Annual Net Sales of each such Picked Product that meet or exceed the threshold set forth below. If a Second Generation Product is sold, the Annual Net Sales associated with such Second Generation Product will be aggregated with the Licensed Compound(s) to which it relates, and separate sales milestones under this Section 9.6(c) shall not be paid for such Second Generation Product. Sales Milestone. ENDO shall pay NOVARTIS AG a non-refundable, non-recoupable, non-creditable sales milestone of $25,000,000 upon the first achievement of Agreement Year Net Sales in excess of $300,000,000. The above sales milestone, if payable, shall be payable only once. If payable, payment of the above sales milestone shall be due to NOVARTIS AG within forty-five (45) days after the end of the Agreement Quarter in which the milestone was reached.
Sales Milestone. If aggregate Net Sales for all Products during the term reach twenty-five million dollars ($25,000,000.00), Endra shall pay Optosonics the sum of two hundred fifty thousand dollars ($250,000.00) no later than January 31 of the year following this occurrence. This payment shall be made only once and shall be in addition to any other payments due under this Agreement.
Sales Milestone. In consideration of the Services provided by SOLMIC pursuant to the Work Order and in consideration of the license granted by SOLMIC to PIVOT pursuant to Section 4.7, PIVOT shall pay to SOLMIC the following sales milestone payment: Milestone Event Payment Amount Aggregate Net Sales of one or more NH Product(s) in the Territory reach
Sales Milestone. Within thirty (30) days following the date when total cumulative Net Sales of Licensed Product sold in the U.S. reach four hundred million U.S. dollars ($400,000,000), Licensee shall make a one-time, non-refundable, non-creditable payment of sixty million U.S. dollars ($60,000,000) to Genentech. The Parties acknowledge and agree that this payment has already been timely made prior to the Amendment Effective Date.
Sales Milestone. (i) Within six (6) months after receiving FDA approval of the NDA or BLA for any Licensed Product, Company, its Affiliate or Sublicensee shall market the approved Licensed Product in a territory, except where a delay occurs due to circumstances beyond Company’s control.
Sales Milestone. BMS shall pay to Tranzyme a one-time sales milestone of [***] when annual Net Sales for the first Licensed Product against each Collaboration Target exceed [***] as further described below. This sales milestone would be due ninety (90) days after the end of the first calendar year in which the annual Net Sales exceed the above threshold. Sales Milestone. Bioscan shall pay to IDSI a one-time payment of US$1,000,000 within thirty (30) days after the sale by Bioscan or its Affiliates, on or after the Market Release Date, of the seven hundred fiftieth (750th) unit of the Product(s).
