San Francisco Embarkation Site Sample Clauses

San Francisco Embarkation Site. The Concessioner shall provide, at its sole cost and expense, throughout the term of this Contract, a San Francisco Embarkation Site as follows: (1) Purpose and Need. For the purpose of providing one set of requirements sufficiently defined such that the criteria set in the National Park Service Concessions Management Improvement Act of 1998, 54 U.S.C. §101911 et seq., regarding the selection process, award, and management of concession contracts may be met, this Contract specifies the location of the San Francisco Embarkation Site and requires that the Concessioner enter into the Lease with the Port (not a party to this Contract) regarding the Concessioner’s use and occupancy of the San Francisco Embarkation Site. These requirements were published in this Contract to provide certainty that would facilitate realistic offers with accurate evaluations of costs by offerors, and thus avoid delay in the award and performance of this Contract. The Concessioner acknowledges that the Lease requires it to construct and maintain certain Embarkation Site Improvements specified therein (and as defined in Section 3(g)(3)(i), below) at its sole cost and expense.
