Common use of Scheduling Work on Paid Holidays Clause in Contracts

Scheduling Work on Paid Holidays. Where the Employer has a requirement for such overtime work to be performed on any Paid Holiday, or day in lieu thereof, the performance of such work by any Employee shall be subject to the following: (a) The Employer shall ask, in seniority order, from highest to lowest, the Employees who normally perform the available work if they want to work on a given Paid Holiday, or day in lieu thereof, and those Employees who accept shall thereby be scheduled to work on that day; (b) If the Employer is unable to secure sufficient personnel to meet the work requirements on a Paid Holiday or day in lieu, the Employer may, subject to the employee’s ability to perform the work, schedule employees who normally perform the available work to do the work in reverse order of seniority, from lowest to highest.
