Schematic Design Phase. 1.2.1 Based on the mutually agreed upon Program of Requirements, Amount Available for the Construction Contract and the Project Schedule, the Architect/Engineer shall prepare sufficient alternative approaches utilizing BIM for design and construction of the Project to satisfy Owner’s project requirements and shall, at completion of this phase, submit Schematic Design Documents derived from the model in accordance with the BIM Execution Plan, “Facility Design Guidelines” and any additional requirements set forth in Article 15. Prior to the Owner’s approval of the Schematic Design Documents, the Architect/Engineer shall incorporate such changes as are necessary to satisfy the Owner’s review comments, any of which may be appealed for good cause.

The Architect/Engineer shall provide written commentsadvise the Owner of any adjustments to the project scope necessary to align the cost estimate and the project budget with the established Amount Available for Construction Contract and revise the Schematic Design Documents as may be required. 1.2.5 Before proceeding into the Design Development Phase, the Architect/Engineer shall obtain Owner’s written acceptance of the Schematic Design documents and approval of the Architect/Engineer’s preliminary Estimated Construction Cost and schedule. 1.2.6 The Architect/Engineer shall participate in a final review of the Schematic Design Documents and model(s) with the Owner and Construction Manager at the Project site or other location specified by Owner in the State of Texas. Prior to the Owner’s approval of the Schematic Design Documents, the Architect/Engineer shall incorporate such changes as are necessary to satisfy the Owner’s review comments, any of which may be appealed for good cause.

The Architect/Engineer shall review alternative approaches to design and construction for the Project as they are being modeled at intervals appropriate to the progress of the Project meet with the Owner and Construction Manager to arrive at a mutual understanding of the Project site or other location specified requirements of the Final Design Program approved in writing by the Owner within and the State of TexasAuthority. 7.4.2 The Designer shall submit a proposed design work plan pursuant to this Contract including anticipated tasks and submittals. The Architect/Engineer Designer shall utilize also submit to the model(sOwner a proposed schedule consistent with any Project Schedule included in the RFS (Attachment B) to support the review process during Schematic Designmodified as required by any subsequent schedule changes or delays outside of Designer’s control. The Architect/Engineer schedule shall provide contain dates for submittals, deliverables, actions, milestones, design workshops, meetings and the Construction Manager with a compact disc containing documents and data files derived from the model to assist the Construction Manager in fulfilling its responsibilities to critical path through all design service activities. It shall include time for the Owner. 1.2.2 Architect/Engineer shall provide all services necessary to perform 's and the services of this phase (preparation of model(s), relevant data, decision support model views and Schematic Design Documents) including, without limitation, unless otherwise approved by Owner, the preparation and prompt delivery of all items specified in the BIM Execution Plan and “Facility Design Guidelines”. 1.2.3 Architect/Engineer shall work closely with Owner in preparation of schematic drawings and shall specifically conform to Owner’s requirements regarding aesthetic design issues. 1.2.4 The Architect/Engineer shall Authority's review the Estimated Construction Cost prepared by the Construction Manager, and shall provide written comments. 1.2.5 Before proceeding into the Design Development Phase, the Architect/Engineer shall obtain Owner’s written acceptance of the Schematic Design documents and approval of submittals and for necessary submissions for permits in connection with the Architect/Engineer’s preliminary Estimated Construction Cost Project. The work plan shall also include a work plan schedule of values consistent with Attachment A, which shall be the basis for which payments of the Fee for Basic Services within each Phase shall be made. The work plan schedule of values shall identify deliverables within each Phase and schedulepercentages of the phase fee payable upon completion of such deliverable. When approved by the Owner as provided in Article 7.4.8, the work plan schedule of values shall govern the timing of payments of the Fee for Basic Services upon completion of deliverables within each Phase and as each Phase progresses. 1.2.6 7.4.3 The Architect/Engineer shall participate in Designer shall: Prepare a final preliminary evaluation of the Recommended Preferred Solution from the Feasibility Study, the Final Design Program, and Proposed Total Project Budget; collect and study all available drawings, reports, maintenance reports, and other existing data pertaining to the Project; conduct a thorough on-site review of conditions relating to the Project; assure that the “Recommended Preferred Solution” complies with all applicable codes and regulations, including any special design standards supplied by the Authority and its Commissioning Consultant; and meet with local building officials to identify and confirm applicable standards, codes and any project specific criteria. 7.4.4 The Designer shall develop the Recommended Preferred Solution to a full schematic design level. Schematic design level documentation shall be based on the Final Design Documents Program, shall incorporate Owner and model(sAuthority comments and shall include each of the following, to the extent applicable to the Recommended Preferred Solution: (a) Traffic Analysis - analyze the impact of anticipated vehicular and pedestrian traffic, including impacts to existing infrastructure, to determine efficient and safe site access. (b) Environmental and Existing Building Assessment – Provide additional site and building assessments as may be required to quantify presence of unsuitable materials and scope of possible remediation efforts. (c) Geotechnical and Geoenvironmental Analysis – Provide additional geotechnical analysis as may be required to describe soil conditions, remediation requirements and appropriate foundation. (d) Program Analysis - a space measurement analysis for the design which shall verify that the sum of all program floor areas plus all other floor areas equal the gross floor area of the Final Design Program. (e) Code Analysis – Determine the impact of all applicable federal, state, regional and local codes, regulations and ordinances, including a listing of permitting and other regulatory filing requirements. (f) Utility Analysis – Determine the availability and capacity of all required building utilities. Provide soils analysis and preliminary design for on-site septic/sewage treatment facilities, if required. (g) Massing Study – an analysis of the building’s integration into its surroundings and neighborhood with drawings, models, or photographs. (h) MA-CHPS or LEED-S Scorecard – Pursuant to the Authority’s Sustainable Building Design Guidelines complete a MA-CHPS or LEED-S for Schools Scorecard and describe sustainable design features and each high performance green school prerequisite and credit included in the proposed design and a plan for implementation or inclusion of any appropriate public utility energy conservation design programs. (i) Accessibility - an analysis of the design's compliance with the Owner Americans with Disabilities Act (ADA) and Construction Manager at the Project site or other location specified by Owner in the State of Texas. Prior to the Owner’s approval of the Schematic Design Documents, the Architect/Engineer shall incorporate such changes as are necessary to satisfy the Owner’s review comments, any of which may be appealed for good causeMassachusetts Architectural Access Board requirements (MAAB).

Schematic Design Phase. 1.2.1 Based 3.1.1 The Architect shall consult with the Owner to ascertain the requirements of each School Project and shall confirm such requirements to the Owner. The Architect shall assist in the programming by writing up his/her interpretation of each School Project as given and discussed and shall furnish copies of same to the Owner for approval before proceeding with preliminary designs. The Architect shall prepare and deliver to the Owner on 11x17 format, a schematic plan with agreed-upon detailing, diagrams, and formatting, to be catalogued with other related projects. 3.1.2 The Architect shall prepare options described in schematic design studies leading to a recommended scope together with a general description of each School Project for approval by the Owner. The Architect shall include indication of any future growth and expansion in outline form. The Architect shall provide digital access to drawings throughout the process to allow the Owner to provide sketches, xxxx-ups and for general communications purposes with the Owner’s staff. The Architect shall provide four (4) sets of drawings for Owner comment and the Owner shall provide one (1) set returned to Architect with Owner comment. A project file share system, agreeable to all parties shall be set up and utilized by the Architect and XXXX for purpose of sharing critical drawings, specifications, and other coordination documents. 3.1.3 The Architect shall assist with and review the XXXX’x Statement of Probable Project Construction Cost (SPCC), comparing its cost assumptions based on current area, volume or other unit costs, based on the mutually agreed Architect’s experience on similar projects. Where the Owner has requested the services of a third-party cost estimator (which the Owner anticipates will be limited to projects exceeding $500,000), the Architect shall include this information in the SPCC review. Prior to submitting the aforementioned Statement of Probable Project Construction Cost, the Architect shall review its construction cost estimates in comparison with the XXXX’x construction cost estimate (if required, based on the XXXX’x monthly cash flow model as required in the XXXX’x contract with the Owner) and shall identify subcontractor work that is critical to the schedule, budget, and overall success of the project to meet the Owner’s goals.. In additional to the aforementioned Statement, including with the same submittal, the Architect shall submit to the Owner, upon Program of Requirementsrequest, Amount Available for a monthly cash flow model based upon the Construction Contract Project’s scope, Appendix And completion date and additional project cash flow information provided by the XXXX to the Architect and the Project Schedule, the Architect/Engineer shall prepare sufficient alternative approaches utilizing BIM for design and construction of the Project to satisfy Owner’s project requirements and shall, at completion of this phase, submit Schematic Design Documents derived from the model in accordance with the BIM Execution Plan, “Facility Design Guidelines” and any additional requirements set forth in Article 15. . 3.1.4 The Architect/Engineer Architect shall review alternative approaches to design and construction for the Project and the Schematic Design Documents as they are being modeled prepared at intervals appropriate to the progress of the Project with the Owner and Construction Manager the XXXX at the Project site or other location specified by the Owner within the State of TexasOwner’s Office. The Architect/Engineer shall utilize the model(s) to support the review process during Schematic Design. The Architect/Engineer Architect shall provide the Construction Manager XXXX with a compact disc containing copies of the Architect’s documents and data files derived from at the model XXXX’x expense to assist the Construction Manager XXXX in fulfilling its responsibilities to the Owner. 1.2.2 Architect/Engineer 3.1.5 The Architect shall provide all services necessary submit to perform the services Department of Public Instruction of the State of North Carolina, School Planning Section, the Department of Insurance of the State of North Carolina, the Boiler Safety Bureau, the Elevator and Amusement Device Bureau of the North Carolina Department of Labor, the North Carolina Department of Environment and Natural Resources, the U.S. Army Corps of Engineers, Buncombe County Building Code and Fire Code enforcement offices, and utility providers schematic design studies for the purpose of obtaining their advice and recommendations, as required for the scope of this phase Project. Any changes recommended or required by said agencies and utility providers shall, with the approval of the Owner, be made by the Architect without additional expense on the part of the Owner. The Architect shall cooperate with the Owner’s separately contracted consultants (preparation of model(s), relevant data, decision support model views and Schematic Design Documents) including, without limitation, unless otherwise approved access control integrator, intrusion security vendor, VBA vendor, and/or communications vendor) specialists and staff to incorporate features deemed important to the Project by the Owner, the preparation and prompt delivery of all items specified in the BIM Execution Plan and “Facility Design Guidelines”. 1.2.3 Architect/Engineer 3.1.6 The Owner shall work closely with Owner in preparation of schematic drawings and shall specifically conform have the right to Owner’s requirements regarding aesthetic design issues. 1.2.4 The Architect/Engineer shall review the Estimated Construction Cost prepared by the Construction Manager, and shall provide written comments. 1.2.5 Before proceeding into the Design Development Phase, the Architect/Engineer shall obtain Owner’s written acceptance of have value engineering analyses performed during the Schematic Design documents and approval phase of the Architect/Engineer’s preliminary Estimated Construction Cost services and schedulethe Architect shall make such changes in the plans, specifications and other documents as the Owner may direct resulting from such analyses without additional compensation. This includes delineation of bid alternates to maximize improvements within available funding, and in recognition of a volatile bid environment. 1.2.6 3.1.7 The Architect/Engineer shall participate in Owner reserves the right to delete a final review portion of the Schematic Design Documents and model(s) with the Owner and Construction Manager at the Project site or other location specified by Owner in the State scope of Texas. If the Statement of Probable Construction Cost exceeds the Owner’s construction budget, the Owner and Architect shall mutually agree to revisions to the program, the budget, or both. The Architect shall specify the requirements for all Owner-supplied information sufficiently in advance so as not to impede the orderly progress of the Project. If the Architect believes its own efforts are being hindered or delayed by reason of failure by the Owner to supply necessary information or guidance, the Architect shall immediately advise the Owner in writing, specifying the requirements in detail. 2.2.8 The Architect shall prepare and distribute written minutes of all items specified in the BIM Execution Plan and “Facility Design Guidelines”. 1.2.3 Architect/Engineer shall work closely with Owner in preparation of schematic drawings and shall specifically conform to Owner’s requirements regarding aesthetic design issues. 1.2.4 The Architect/Engineer shall review the Estimated Construction Cost prepared by the Construction Manager, and shall provide written comments. 1.2.5 Before proceeding into the Design Development Phase, the Architect/Engineer shall obtain Owner’s written acceptance of meetings conducted during the Schematic Design documents Phase and approval subsequent Design Development Phase and Construction Documents Phase of the Architect/Engineer’s preliminary Estimated Construction Cost and scheduleProject. 1.2.6 2.2.9 The Architect/Engineer Architect shall participate agree to be guided by the following statement in designing the contemplated Work: .1 conceive the most practical design that is consistent with the general character of the University and compatible with the specified use; .2 economy of construction shall be compatible with material durability and the objective of obtaining the maximum usable space per construction dollar; and .3 economy of operation with the objective of reducing, as far as possible, the costs of maintenance, repairs, service utilities, heating, and air conditioning. 2.2.10 The Architect shall prepare area calculations, in a final review of the Schematic Design Documents and model(s) with the Owner and Construction Manager at the Project site or other location specified form acceptable to Owner, as required by Owner in the State of Texas. Prior to the Owner’s approval of the Schematic Design Documents, the Architect/Engineer shall incorporate such changes as are necessary to satisfy the Owner’s review comments, any of which may be appealed for good cause.

The Architect/Engineer shall provide the Construction Manager with a compact disc containing documents and data files derived from the model to assist the Construction Manager in fulfilling its responsibilities to the Owner. 1.2.2 Architect/Engineer shall provide all services necessary to perform the services of this phase (preparation of model(s), relevant data, decision support model views and Schematic Design Documents) including, without limitation, unless otherwise approved by Owner, the preparation and prompt delivery of all items specified in the BIM Execution Plan and “Facility Design Guidelines.”. 1.2.3 Architect/Engineer shall work closely with Owner in preparation of schematic drawings and shall specifically conform to Owner’s requirements regarding aesthetic design issues. 1.2.4 The Architect/Engineer shall review direct the preparation of a detailed Estimated Construction Cost prepared by as described in Sub-paragraph 1.1.19 to confirm compliance with the Amount Available for the Construction Manager, Contract and include it with the completed Schematic Design Documents. The Architect/Engineer shall provide written commentsadvise the Owner of any adjustments to the project scope necessary to align the cost estimate and the project budget with the established Amount Available for Construction Contract and revise the Schematic Design Documents as may be required. 1.2.5 Before proceeding into the Design Development Phase, the Architect/Engineer shall obtain Owner’s written acceptance of the Schematic Design documents and approval of the Architect/Engineer’s preliminary Estimated Construction Cost and schedule. 1.2.6 The Architect/Engineer shall participate in a final review of the Schematic Design Documents and model(s) with the Owner and Construction Manager at the Project site or other location specified by Owner in the State of Texas. Prior to the Owner’s approval of the Schematic Design Documents, the Architect/Engineer shall incorporate such changes as are necessary to satisfy the Owner’s review comments, any of which may be appealed for good cause.

Schematic Design Phase. 1.2.1 Based on the mutually agreed upon Program of RequirementsFacilities Program, Amount Available for the Construction Contract Cost Limitation and the Project Schedule, the Architect/Engineer Project Architect shall prepare sufficient alternative approaches utilizing BIM for to design and construction of the Project to satisfy Owner’s project requirements and shall, at completion of this phase, submit Schematic Design Documents derived from the model in accordance with the BIM Execution Plan, “Facility Owner’s Design Guidelines” Guidelines and any additional requirements set forth in Article 1514. The Architect/Engineer Project Architect shall review alternative approaches to design and construction for the Project and the Schematic Design Documents as they are being modeled prepared at intervals appropriate to the progress of the Project with the Owner and Construction Manager at the Project site location or other location specified by the Owner within the State of Texas. The Architect/Engineer shall utilize the model(s) to support the review process during Schematic Design. The Architect/Engineer Project Architect shall provide the Construction Manager with a compact disc containing copies of the Project Architect’s documents and data files derived from at the model Construction Manager’s expense to assist the Construction Manager in fulfilling its responsibilities to the Owner. 1.2.2 Architect/Engineer Project Architect shall provide all services necessary to perform the services of this phase Phase (preparation of model(s), relevant data, decision support model views and Schematic Design Documents) including, without limitation, unless otherwise approved by Owner, the preparation and prompt delivery of all items specified in the BIM Execution Plan and “Facility Owner’s Design Guidelines”. 1.2.3 Architect/Engineer Project Architect shall work closely with Owner in preparation of schematic drawings and shall specifically conform to Owner’s requirements regarding aesthetic design issues. 1.2.4 The Architect/Engineer Project Architect shall furnish and deliver to the Owner the number of complete printed sets of Schematic Design documents as enumerated in Article 14. 1.2.5 The Project Architect shall direct the preparation of a detailed construction cost estimate as described in Sub-paragraph 1.1.15 to confirm compliance with the Construction Cost Limitation and include it with the completed Schematic Design Documents. The Project Architect shall advise the Owner of any adjustments to the project scope necessary to align the cost estimate and the project budget with the established Construction Cost Limitation and revise the Schematic Design Documents as may be required. The Project Architect shall review its construction cost estimate in comparison with the Estimated Construction Cost construction cost estimate prepared by the Construction Manager, and shall reconcile any differences between the two construction cost estimates in coordination with the Construction Manager. If the Project Architect is unable to reconcile all differences between the two construction cost estimates with the Construction Manager, then the Project Architect shall provide written commentsa detailed explanation of the differences to the Owner. 1.2.5 1.2.6 The Project Architect shall participate in a final review of the Schematic Design Documents with the Owner and Construction Manager at the Project location or other location specified 1.2.7 Before proceeding into the Design Development Phase, the Architect/Engineer Project Architect shall obtain Owner’s written acceptance of the Schematic Design documents and approval of the Project Architect/Engineer’s preliminary Estimated Construction Cost construction cost estimate and schedule. 1.2.6 The Architect/Engineer shall participate in a final review of the Schematic Design Documents and model(s) with the Owner and Construction Manager at the Project site or other location specified by Owner in the State of Texas. Prior to the Owner’s approval of the Schematic Design Documents, the Architect/Engineer shall incorporate such changes as are necessary to satisfy the Owner’s review comments, any of which may be appealed for good cause.

Schematic Design Phase. 1.2.1 Based on 2.2.1 The A/E will prepare Schematic Design documents to confirm the mutually agreed upon Program scope and budget of Requirements, Amount Available for the Construction Contract and Schematic Design Documents provided. The Schematic Design documents shall include narrative with preliminary drawings as required to confirm the Project ScheduleSchematic Design Documents provided. At the completion of Schematic Design Phase, the ArchitectA/Engineer E's team shall prepare sufficient alternative approaches utilizing BIM for design a preliminary Construction Cost Estimate and construction of Project schedule. At the Project to satisfy Owner’s project requirements and shall, at completion of this phase, the A/E shall submit Schematic Design Documents derived from the model in accordance with the BIM Execution Plan, “Facility Owner’s Design Guidelines” Guidelines and any additional requirements set forth in Article 15of this Agreement. The ArchitectA/Engineer E shall review alternative approaches to design all laws, codes, and construction for the Project as they are being modeled at intervals appropriate regulations applicable to the progress of the Project with the Owner and Construction Manager at the Project site or other location specified by the Owner within the State of Texas. The ArchitectA/Engineer shall utilize the model(s) E’s services as it relates to support the review process during Schematic Design. The Architect/Engineer shall provide the Construction Manager with a compact disc containing documents and data files derived from the model to assist the Construction Manager in fulfilling its responsibilities to the Ownerthis Project. 1.2.2 Architect/Engineer A/ E shall provide all services necessary to perform the services of this phase Phase (preparation of model(s), relevant data, decision support model views and Schematic Design Documents) including, without limitation, unless otherwise approved by Owner, the preparation and prompt delivery of all items specified in the BIM Execution Plan and “Facility Owner's Design Guidelines”. 1.2.3 Architect. A/Engineer E shall work closely with Owner in preparation of schematic drawings Design documents and shall specifically conform to Owner’s 's requirements regarding aesthetic design issues. 1.2.4 2.2.2 The ArchitectA/Engineer E shall furnish and deliver to the Owner two (2) complete printed sets of Schematic Design documents. The A/E will analyze the existing building assessment (to the extent necessary for the Project), program of spaces, and preliminary schematic design and verify alignment of the project scope and budget. Schematic Design will include the following steps: • Kick-off meeting with Owner’s Representative to confirm vision for the building • Site evaluation to confirm the building assessment report provided by the Owner, to the extent necessary for the Project • Determine if more detailed investigative testing to confirm the existing conditions is required • Meeting with Owner’s Representative to review initial findings • Incorporate Owner’s comments 2.2.3 The A/E shall direct the Estimated preparation of a detailed Construction Cost prepared by Estimate as described in Sub-paragraph 2.1.8.1 to confirm adherence to the Construction Manager, Cost Limitation and shall provide written commentspresent the same with the completed Schematic Design Documents. 1.2.5 2.2.4 Before proceeding into the Design Development Phase, the ArchitectA/Engineer E shall obtain Owner’s written acceptance of the Schematic Design documents and approval of the ArchitectA/EngineerE’s preliminary Estimated Construction Cost and scheduleEstimate. 1.2.6 2.2.5 The Architect/Engineer Schematic Design documents shall participate in consist of a final review of narrative, drawings and other documents including a site plan, if appropriate, and preliminary buildings plans, sections and elevations as required to confirm the Schematic Design Documents provided; and model(s) may include some combination of study models, perspective sketches, or digital modeling. Preliminary selections of major building systems and construction materials shall be noted on the drawings or described in writing. 2.2.6 The A/E shall consider environmentally responsible design alternatives, such as material choices and building orientation, together with other considerations based on program and aesthetics, in developing a design that is consistent with the Owner Owner’s Program, schedule and budget for the Construction Manager at Cost Estimate. 2.2.7 The A/E shall submit the Project site or other location specified by Owner in the State of Texas. Prior Schematic Design Documents to the Owner’s approval of the Schematic Design Documents, the Architect/Engineer shall incorporate such changes as are necessary to satisfy and request the Owner’s review comments, any of which may be appealed for good causeapproval.
