SCHOOL AND PARK CONTRIBUTIONS. Pursuant to the provisions of Section 6 of Subdivision Control Ordinance of the City Code (sometimes herein referred to as the “Subdivision Regulations”), the Parties agree that neither land contributions, or cash in lieu of land contributions, for schools or parks is applicable to the Subject Realty as no residential use is proposed or authorized for the Subject Realty hereunder.

SCHOOL AND PARK CONTRIBUTIONS. The City’s Municipal Code establishes the City policy with respect to contributions to be made by developers of real estate being annexed to the City to the Geneva Park District and Geneva School District. The amounts of the contributions to be paid for said School and Park Districts shall be as calculated pursuant to applicable provisions of the Batavia City Code. The fees provided in Sections 11-6-1 and 11-6-3 of the Subdivision Ordinance shall be waived if the Developer/Owner constructs the senior apartment complex on the Property as planned, subject to receipt of a written consent to such waiver by the Geneva School District. If the Property is developed as a multi-family development without age restriction, or if the Geneva School District does not consent to the waiver, all of the fees provided in Sections 11-6-1 and 11-6-3 shall apply. In the alternative, the Developer/Owner may enter into an agreement with the Geneva School District to deviate from the formulas in the City code. In the event Developer independently reaches agreement with the Geneva School District with respect to contributions, the amounts calculated pursuant to the City Code shall be adjusted to reflect such agreement. Except as set forth in this Article XV and otherwise expressly provided in this Agreement (and except for fees charged by other governmental authorities, including, without limitation, Xxxx County), no impact fees, donations, contributions or other charges whatsoever shall be due or payable, and Developer shall not be liable for payment of any other such fees, donations or contributions, in connection with the development of the Property.
