Common use of Scope of Development Clause in Contracts

Scope of Development. The Developer shall construct and develop or cause to be constructed and developed, in substantial compliance with the times set forth in the Performance Schedule, all Improvements which the Developer is obligated to construct and develop with respect to the Project under this Agreement. The Developer shall construct all Improvements in accordance with all applicable laws and building and permitting codes.

Scope of Development. The Developer shall construct and develop or cause to be constructed and developed, in substantial compliance with the times set forth in the Performance ScheduleSchedule (subject in all cases to authorized extensions of the applicable Performance Schedules contemplated by this Agreement), all Improvements the Initial Improvements, which the Developer is obligated to construct and develop with respect to under the Project under Performance Schedule and this Agreement. The Developer shall construct For purposes of clarity, the Performance Schedule is subject at all Improvements in accordance with all applicable laws and building and permitting codestimes for extension due to a Construction Delay as authorized by this Agreement.

(b) All Improvements shall be constructed by the Developer shall construct all Improvements in accordance with all applicable laws and pursuant to a building and permitting codespermit or permits, if applicable, issued by the City covering each such Improvement.
