Common use of Second Maintenance Term Clause in Contracts

Second Maintenance Term. 4.2.1 TxDOT, in its sole and absolute discretion, shall have the option to extend the term of this Capital Maintenance Agreement for an additional five years (the “Second Maintenance Term”). The Second Maintenance Term shall commence as of the expiration of the Initial Maintenance Term and shall continue for a period of five years, unless terminated earlier in accordance with the terms hereof.
