Second Order. Within ninety (90) days of the delivery of the Units comprising the First Order into the Territory, the Purchaser will make a second non-refundable deposit for the purchase of five (5) additional Units to Taronis in an amount equal to twenty-five percent (25%) of the Unit Purchase Price per Unit, which amount is $3,515,625 (“Second Order”).

Second Order. (1) The Agreement is hereby amended to provide that Contractor shall provide to Federal the items listed in the Second Order set forth in Exhibit A which is attached hereto and incorporated herein by reference (the “Initial Order”) for the total fee of Ninety-Two Thousand One Hundred and Seventy-Nine Dollars and Ninety-Nine Cents ($92,179.99). (2) For the Second Order under this Amendment, the parties agree that this Amendment shall serve as a purchase order and as confirmation for such purchase without the necessity for the issuance of any further ordering documentation.
Second Order. (1) Upon Federal’s acceptance of the testing of the first three (3) Equipment units acquired pursuant to FedEx Contract No. 00-0000-000, Contractor agrees to perform, on behalf of Federal, the additional services described in Exhibit A which is attached hereto and incorporated herein by reference (the “Second Order Services”). (2) In exchange for performing the Second Order Services, Contractor shall receive a fee which in no event shall exceed the maximum amount of Thirteen Thousand Four Hundred Dollars ($13,400.00), plus applicable taxes.   • Project Closeout a. Participate in final inspection to prepare punch lists for project contractor to correct and/or to complete listed items. Buyer agrees that it will promptly take such actions as are reasonably requested by any Seller to assist in obtaining Bankruptcy Court approval of the Sale Order, including furnishing affidavits or other documents or information for filing with the Bankruptcy Court for purposes, among others, of (A) demonstrating that Buyer is a “good faith” purchaser under section 363(m) of the Bankruptcy Code and (B) establishing adequate assurance of future performance within the meaning of section 365 of the Bankruptcy Code.

  • Contract Closure Contracting Officer shall give appropriate written notice to Purchaser when Purchaser has complied with the terms of this contract. Purchaser shall be paid refunds due from Timber Sale Account un- der B4.24 and excess cooperative deposits under B4.218.

  • Contract Closeout The Provider Agency shall comply with all requirements of Policy Circular P7.01, Contract Closeout, including the timely submittal of the Final Report of Expenditures and any other financial or programmatic reports required by the Department. All required documentation is due within 120 Days of Contract Expiration, Non-renewal or Termination.
