Section 24.2.5 Sample Clauses

Section 24.2.5. 2 If no settlement has been reached within the thirty (30) days referred to in the preceding 3 subsection, and the grievant and the Association believe the grievance to be valid, the employee 4 may demand arbitration of the grievance. The grievance may be submitted by the Association 5 to final and binding arbitration. Such arbitration shall be conducted by an arbitrator under the 6 rules and administration of the American Arbitration Association. The parties to this agreement 7 shall then be bound by the rules and procedures of the American Arbitration Association, and 8 the decision of the arbitrator shall be final and binding. During the arbitration under this step, 9 neither the District nor the grievant will be permitted to assert any grounds not previously 10 disclosed to the other party. The arbitrator shall not have the power to alter, modify, amend, 11 add to, or subtract any of the terms of this agreement or substitute his/her judgment for that of 12 the parties.

Section 24.2.5. 20 The arbitrator shall commence hearings within a reasonable period of time after selection, and 21 shall render an award in writing within thirty (30) calendar days. The award of the arbitrator, 22 together with written findings and conclusions, shall be final and binding upon the parties to 23 this Agreement and upon the complaining employee or employees, if any. The Arbitrator is not 24 vested with the power to change, alter, modify, add to or subtract from this Agreement in any 25 of its parts.
Section 24.2.5. Section 24.25 of the Lease is hereby amended to delete the reference toSection 11” in Section 24.25 of the Lease and replace it with “Section 12”.

  • SECTION 312 The Primary Servicer shall promptly (but in no event later than thirty (30) days after the related inspection or receipt of the inspection report, which ever is later, or collection, as applicable) forward to the Master Servicer a copy of all inspection reports prepared by the Primary Servicer and all operating statements, budgets, rent rolls and financial statements collected by the Primary Servicer. The Primary Servicer may engage a third party at its cost to perform property inspections and prepare property inspection reports without first obtaining the consent of the Master Servicer; provided, however, that the Primary Servicer shall remain obligated and primarily liable to the Master Servicer for satisfactory completion of the inspections and reports as required by this Agreement. If any inspection report identifies a “life safety” or other material deferred maintenance item existing with respect to the related Mortgaged Property, the Sub-Servicer (x) shall promptly send to the related Borrower (with a copy to the Master Servicer by email to xxxxxx@xxxxxxxxxx.xxx) a letter identifying such deferred maintenance item and instructing the related Borrower to correct such deferred maintenance item and (y) shall notify the Master Servicer (by email to xxxxxx@xxxxxxxxxx.xxx) upon resolution of such life safety or deferred maintenance item.
