Section 8 Housing. Department is renting the above-referenced property to Tenant for occupancy by Xxxxxx’s family with assistance for a tenancy under the Section 8 housing choice voucher program (voucher program) of the United States Department of Housing and Urban Development (HUD). Department has entered into a Housing Assistance Payments Contract (HAP contract) with the local Public Housing Authority (PHA), , under the voucher program. Under the HAP contract, the PHA will make housing assistance payments to Department to assist Xxxxxx(s) in renting the property from Department. Department has given the PHA a copy of the rental agreement, including any revisions agreed by Department and Xxxxxx(s). Department certifies that the terms of the rental agreement are in accordance with all provisions of the HAP contract and that the rental agreement includes the voucher program tenancy addendum current at the time of execution of this Agreement. Section 8 Housing. The Developer shall accept tenants who are recipients of federal certificates for rent subsidies pursuant to the existing program under Section 8 of the United States Housing Act of 1937, as amended, codified as 42 U.S.C. Sections 1401 et seq., or its successor. During the term of this Declaration, the Developer shall not adopt any policies specifically excluding rental to tenants holding Section 8 certificate/voucher holders. For certificate/voucher holders, the Developer shall restrict rents to an amount which does not exceed the rent permitted, assuming the total tenant payment does not exceed 40% of the household’s monthly adjusted income.
