Seller’s Regulatory and Governmental Filings. (i) Within one hundred eighty (180) days after the Effective Date, Seller shall file an application or other appropriate request for CEC Pre-Certification for the Generating Facility.
(ii) Within six hundred and ten (610) days after the Effective Date, Seller shall file all applications or other appropriate requests with the proper authorities for all Material Permits, and shall promptly respond to any requests for information from the requesting authority.
Seller’s Regulatory and Governmental Filings. (i) Within one hundred eighty (180) days after the Effective Date, Seller shall file an application or other appropriate request for CEC Pre-Certification for the Generating Facility.
(ii) Within one hundred eighty (180) days after the Effective Date, Seller shall file all applications or other appropriate requests with the proper authorities for Construction Permits.
(iii) Seller shall expeditiously seek CEC Pre-Certification and all Material Permits, including promptly responding to any requests for information from the requesting authority.
(iv) Within thirty (30) days after the Commercial Operation Date, Seller shall file an application or other appropriate request with the CEC for CEC Certification for the Generating Facility.
(v) Seller shall expeditiously seek CEC Certification and maintain CEC Verification, including promptly responding to any requests for information from the requesting authority.
Seller’s Regulatory and Governmental Filings. (i) On or before the date that is six (6) months prior to the Expected Initial Operation Date, Seller shall file or cause to be filed on its behalf:
(1) An application or other appropriate request with the CEC for CEC Certification and Verification for the Generating Facility (provided that Seller shall not be required to file or cause to be filed such application or request if the Generating Facility is ineligible for CEC Certification and Verification as a result of a change in the RPS Legislation, or the rules or regulations relating thereto, after the Master Agreement Effective Date, and Seller is unable to make such Generating Facility eligible through commercially reasonable efforts (which efforts to make the Generating Facility eligible shall not require Seller to incur out of pocket costs in excess of $25,000 in any year with respect to the Generating Facility in order to obtain CEC Certification and Verification)); and
(2) All applications or other appropriate requests with the proper authorities for all other Permits that can be obtained at that stage of the development process.
(ii) After filing its applications or other appropriate requests as provided in Sections 2.02(b)(i)(1) and 2.02(b)(i)(2) above, Seller shall expeditiously seek CEC Certification and Verification (subject to Section 2.02(b)(i)(1)) and all Permits, including, among other things, promptly responding to any requests for information from the requesting authority.
Seller’s Regulatory and Governmental Filings. (i) Within one hundred eighty (180) days after the Effective Date, Seller shall file all applications or other appropriate requests with the proper authorities for all other Permits.
Seller’s Regulatory and Governmental Filings. Within one hundred eighty (180) days after the Effective Date, Seller shall file or have filed:
(i) An application or applications, or other appropriate request or requests with the appropriate Governmental Authority for all Permits; and
(ii) An application or other appropriate request to the CEC for CEC Certification and Verification. Seller shall expeditiously seek to obtain all Permits and CEC Certification and Verification, including promptly responding to any requests for information from the requesting authority, and SCE shall use commercially reasonable efforts to cooperate with and support Seller in obtaining all such Permits and CEC Certification and Verification.
Seller’s Regulatory and Governmental Filings. (i) Within one hundred eighty (180) days after the Effective Date, Seller shall file:
(1) An application or other appropriate request with the CEC for CEC Certification and Verification for the Generating Facility, provided that Seller shall not be required to file such application or request if: (a) the Generating Facility is ineligible for CEC Certification and Verification as a result of a change in the RPS Legislation, or the rules and regulations relating thereto, after the Effective Date; (b) the Generating Facility would have been eligible for CEC Certification and Verification under the RPS Legislation, and the rules and regulations relating thereto, in effect as of the Effective Date; and (c) Seller is unable to make such Generating Facility eligible for CEC Certification and Verification through commercially reasonable efforts (which efforts shall not require Seller to incur out-of-pocket costs in excess of $15,000 in any year); and
(2) All applications or other appropriate requests with the proper authorities for all other Permits that are reasonably required to be, or are customarily, filed within such period.
(ii) Seller shall expeditiously seek CEC Certification and Verification (subject to Section 2.02(c)(i)(1)) and all Permits, including promptly responding to any requests for information from the requesting authority.
Seller’s Regulatory and Governmental Filings. Within one hundred eighty (180) days after the Effective Date, Seller shall file an application or other appropriate request for CEC Pre‑Certification for the Generating Facility. Within one hundred eighty (180) days after the Effective Date, Seller shall file all applications or other appropriate requests with the proper authorities for Construction Permits. Seller shall expeditiously seek CEC Pre‑Certification and all Material Permits, including promptly responding to any requests for information from the requesting authority. Within thirty (30) days after the Commercial Operation Date, Seller shall file an application or other appropriate request with the CEC for CEC Certification for the Generating Facility. Seller shall expeditiously seek CEC Certification and maintain CEC Verification, including promptly responding to any requests for information from the requesting authority. Seller shall have FERC approved Market Base Rate Authority, if applicable, upon Commercial Operation Date.
Seller’s Regulatory and Governmental Filings. (i) Seller shall have received, and will maintain throughout the Term, CEC Certification.
Seller’s Regulatory and Governmental Filings. (i) No later than forty-eight (48) months prior to the Forecasted Initial Operation Date, Seller shall file an application or other appropriate request with the CEC for CEC Pre-Certification for the Generating Facility.
(ii) No later than thirty-six (36) months prior to the Forecasted Initial Operation Date, Seller shall:
(1) file an application or other appropriate request with the CEC for CEC Certification and Verification for the Generating Facility;
(2) receive CEC Pre-Certification for the Generating Facility; and
(3) propose a methodology (the “Renewable/Non-Renewable Fuel Use Methodology”) to the CEC and the WREGIS administrator for determining the relative quantities of the energy output from the Generating Facility using renewable and non- renewable fuels.
(iii) Seller shall file all applications or other appropriate requests with the proper authorities for all Material Construction Permits (including the CEC AFC if the Site is located in the State of California) in accordance with the Construction Permit Schedule, and promptly respond to any requests for information from the requesting authority.
