SHOP XXXXXXX. 7.01 The Employer agrees to the operation of a Shop Xxxxxxx System which shall be governed by the following: (1) Shop Stewards may be appointed by the Union on the basis of one (1) Shop Xxxxxxx for every fifty (50) employees covered by this Agreement, or major portion thereof, with a minimum of two (2) Shop Stewards. However, in accordance with this understanding, should it be necessary to assist any employee in presenting a grievance during working hours, he will not leave his work without first obtaining permission from the Supervisor or his designate, which will not be unreasonably withheld. (5) It is agreed that the Xxxxxxx will not absent himself from work unnecessarily during working hours for the purpose of servicing a grievance hereunder. In return for this undertaking, the Employer will compensate the Xxxxxxx at his regular straight time hourly rate for time spent during his regular working hours for such purposes, provided the procedure under Clause 7.01(4) is followed. The Employer reserves the right to limit the time spent in the servicing of a grievance if it deems the time taken to be excessive. This section is not to be interpreted in such a manner as to disqualify the Xxxxxxx from premium rates if he is so entitled. (6) The Employer will contact the Xxxxxxx in person or by written form and not just by e-mail to ensure that all concerns are conveyed with the minimum of delay.

(6) 2. The Employer will contact powers and authority of the Shop Xxxxxxx shall be confined to the investigation and presentation of grievances in person or by written form and not just by e-mail to ensure that all concerns are conveyed accordance with the minimum provisions of delaythis Agreement.
3. A Shop Xxxxxxx has no authority to take strike action or any other action interrupting the Employer’s business, except as authorized by official action of the Union. No employee, Shop Xxxxxxx or group of employees shall have the right to modify or waive any provisions of this Agreement or settle any dispute with the Employer.
4. A Shop Xxxxxxx shall be permitted to investigate, present and process grievances on or off the property of the Employer without loss of time or pay. Any Shop Xxxxxxx and/or alternate required to appear in Court or at the National Labor Relations Board or the New York State Labor Relations Board, or any arbitration proceedings in any matter affecting this Agreement shall be paid only for the straight time hours he/she would have worked in any such day.
5. All conferences between the local Union Shop Xxxxxxx and management shall be conducted during business hours, and shall be without loss of time to the Xxxxxxx. Should a Xxxxxxx be required by management to stay past the end of his shift, all time will be considered time worked.
6. The Shop Xxxxxxx shall enjoy top seniority in regard to layoff and rehiring providing he/she has the ability to do the work.
7. Shop Stewards may not hold the position of Lead Technician.

SHOP XXXXXXX. 7.01 Stewards may be appointed within the rules of the Union to any job or shop of the Employer. The Union agrees to recognize that the person designated as Xxxxxxx shall receive his fair share of the work that he is qualified to perform. The Employer agrees to recognize that Stewards are desirable for the operation proper administration of a Shop Xxxxxxx System which shall be governed by the followingterms of this Agreement, and that no member of the Union will remain on any job where the following rules do not apply:
(A) The Union may appoint one or more Stewards to cover each Employer’s operations and will notify the Employer.
(B) In no case shall a Xxxxxxx suffer discrimination because of the performance of his Union duties.
(C) The Xxxxxxx shall be allowed a reasonable amount of time when necessary to perform the following duties:
1) Shop Stewards may be appointed by the Union . Handle grievances on the basis job or in the shop in accordance with the Agreement in effect, and to report all such grievances to the Union.
2. Check safety, cleanliness, sanitation, heat, lighting, etc., regularly; and to report any unsafe or unclean conditions to the Employer and to the Union.
3. Where a Xxxxxxx has been appointed, new employees shall give the Xxxxxxx a copy of the referral slip.
4. Handle the personal belongings and supervise the immediate care and disposition of a sick or injured employee.
5. When a Xxxxxxx is to be terminated, he shall be given notice on the working day prior to the working day at the close of which he will be terminated.
6. The Xxxxxxx shall not assume any other authority than herein specified.
7. Where more than one (1) Shop man works overtime on a job away from a shop and there has been a Xxxxxxx for every fifty (50) employees covered by this Agreementappointed, or major portion thereof, with a minimum of two (2) Shop Stewards.
(2) One (1) Shop Xxxxxxx, or Union Committee member, shall be appointed by the Union as Chief Shop Xxxxxxx who may present or assist in the presentation of any grievance.
(3) The Shop Xxxxxxx may present or assist in the presentation of any grievance.
(4) It is agreed that the Xxxxxxx shall continue be given the opportunity to perform his regular work in order to maintain efficient operations. (3F) The Shop Xxxxxxx may present Xxxxxxx, without sustaining any loss of pay or assist in the presentation of being subject to any grievance.
(4) It is agreed that the Xxxxxxx shall continue to perform his regular work in order to maintain efficient operations. Howeverdisciplinary measures, in accordance with this understandingmay, should it be necessary to assist any employee in presenting a grievance during working hours, he will not leave carry out his work without first obtaining permission from the Supervisor or his designate, which will not be unreasonably withheldduties under this Collective Agreement.

The Parties to this Collective Agreement agree to the following access provisions with respect to visits by Business Agents and\or International Representatives:
(I) Business Agent or International Representative of the Union as to this Collective Agreement where members of the union are employed by an Employer on the site, shall have access to the job site of the Employer during working hours, investigating or discussing any matter regarding the application of this Collective Agreement; but in no case shall the visit hinder or interfere with the progress of the work.
(J) The Employer will contact party may require that a Business Agent or International Representative seeking access shall first report to the Xxxxxxx in designated person or by written form his representative on the site before carrying out a visit.
(K) Access under Clause A shall be subject to traffic, parking and not just by e-mail safety rules prohibiting or restricting access to ensure a job site or place of work, provided that all concerns are conveyed with where access is so prohibited or restricted, reasonable arrangements so far as practical shall be made to assist the minimum Business Agent or the International Representative to enter or obtain access to the job site or place of delaywork.

SHOP XXXXXXX. 7.01 1. The term ‘shop xxxxxxx’ refers to an Employee who is covered by this Col- lective Agreement and elected by the Dancers to represent them and named as such to the Employer.
2. The shop xxxxxxx shall be elected from among the regular members of the Opera and Ballet, who shall be provided with the opportunity to participate in the election. Kansallisbaletin tanssijat ry shall be entitled to organise the elec- tion where necessary. The election of the shop xxxxxxx may be held at the workplace if so agreed with the Employer in advance.
3. The Employer agrees shall be given written notification of the elected shop xxxxxxx.
4. The principal duty of the shop xxxxxxx, as the representative of Employees covered by this Collective Agreement, is to ensure that this Collective Agree- ment is complied with and to lead negotiations on behalf of the Employees concerning the agreement in the manner agreed upon in section 23 of this Collective Agreement.
5. The shop xxxxxxx shall also represent the Employees in matters concerning the application of labour legislation.
6. In case of any uncertainty or disagreement regarding an Employee’s salary or other employment-related issues, the shop xxxxxxx must be provided with all the information relevant to the operation settlement of the dispute.
7. The shop xxxxxxx is entitled to be informed, at regular intervals agreed lo- cally, of the average monthly earnings of the Employees covered by this Col- lective Agreement by job group and their position in the pay scale of the Col- lective Agreement, in a Shop Xxxxxxx System manner that does not reveal the pay of individual Employees.
8. The shop xxxxxxx’x employment relationship may not be terminated for rea- sons related to his or her position as a shop xxxxxxx.
9. If the regular work of persons elected as shop xxxxxxx prevents them from carrying out their elected duties, this arrangement must not reduce their earn- ings.
10. The shop xxxxxxx’x employment relationship shall not be terminated except in cases where it is mutually agreed that he or she cannot be assigned duties appropriate for his or her profession or otherwise suitable for him or her. The shop xxxxxxx’x employment relationship shall not be terminated due to illness, nor may it be cancelled pursuant to Chapter 8 of the Employment Contracts Act on the grounds that the shop xxxxxxx has violated the admin- istrative provisions concerning working hours or the provisions of chapter 3, section 1 of the Employment Contracts Act. If the Opera and Ballet fails to comply with the afore-mentioned provisions, it shall be obligated to pay the shop xxxxxxx a maximum of 6 months’ salary by way compensation.
11. Where possible, an Employee acting as shop xxxxxxx shall be notified of any termination of employment at least 3 months in advance. The grounds for termination shall always be indicated in such a notification given to the shop xxxxxxx.
12. Advance notice of termination of employment given to the shop xxxxxxx shall also be forwarded to the trade union branch which elected him or her. The above advance notice provisions do not, however, apply in cases where the Employer is legally entitled to terminate employment without advance notice.
13. If necessary, the shop xxxxxxx shall be exempted from work in order to at- tend to his or her duties. Such exemption shall be granted immediately in cases requiring urgent attention.
14. If the shop xxxxxxx attends to the duties agreed on with the Employer outside regular working hours, he or she shall be paid additional work compensation for the time so used, or receive other agreed-upon additional compensation.
15. The shop xxxxxxx is entitled to participate in training courses organised by the Finnish Musicians’ Union and those jointly approved by PALTA annually. The Employer shall pay the shop xxxxxxx attending the training a monthly salary for the duration of the training and reimburse accommodation and travel expenses in accordance with the Travel Annex to the Collective Agree- ment.
16. Where possible, the Opera and Ballet shall make permanent and appropriate facilities available to the shop xxxxxxx for the storage of documents and of- fice supplies necessary for the performance of his or her duties.
17. All negotiation procedures shall be governed by the following:
(1) Shop Stewards may be appointed by the Union on the basis provisions of one (1) Shop Xxxxxxx for every fifty (50) employees covered by this Collec- tive Agreement, or major portion thereof, with a minimum of two (2) Shop Stewards.

(4) It is agreed that the Xxxxxxx shall continue Opera and Ballet through representatives elected to perform his regular work in order to maintain efficient operations. However, the Opera and Ballet’s administrative bodies in accordance with this understanding, should it be necessary to assist any employee in presenting a grievance during working hours, he will not leave his work without first obtaining permission from the Supervisor or his designate, which will not be unreasonably withheldOpera and Ballet Regulations.

Section 3 The xxxxxxx and alternate xxxxxxx have no authority to take strike action or any other action interrupting the Company's business.
Section 4 The xxxxxxx (or alternate) will be paid by the Company for time spent on premises for meetings, grievances or arbitrations scheduled by the Company. This time will be included as Chief Shop Xxxxxxx who may present part of the xxxxxxx'x working hours in computing weekly overtime if time falls within his/her regular schedule. There shall be no pay for time spent on Union business or assist in the presentation Union's investigation of any a grievance.
Section 5 The Company recognizes the employee's right (3including the xxxxxxx) The Shop Xxxxxxx may present or assist in the presentation of any grievance.
(4) It is agreed that the Xxxxxxx shall continue to perform his regular work in order to maintain efficient operations. However, in accordance with this understanding, should it be necessary to assist any employee in presenting a grievance during working hours, he will not leave his work without first obtaining permission from the Supervisor or his designate, which will not be unreasonably withheld.
(5) It is agreed that the Xxxxxxx will not absent himself from work unnecessarily during working hours for the purpose of servicing a grievance hereunder. In return for this undertaking, the Employer will compensate the Xxxxxxx at his regular straight time hourly rate for time spent during his regular working hours for such purposes, provided the procedure under Clause 7.01(4) is followed.
