Shortfall in minimum generation. 7.2.1 During the Term, if for any Contract Year, it is found that: (i) the SPV has not been able to generate minimum energy corresponding to the value of annual CUF within the permissible lower limit of CUF as declared by the SPV, or (ii) if the CUF for any of the Units at any point during any Contract Year, is less than 15% (fifteen percent), or such lower limit as may be prescribed by MSEDCL in this regard, such shortfall in performance shall make the SPV liable to pay the compensation at 1.5 (one point five) times of the Tariff for such shortfall. Notwithstanding the above, the lower limit may, however, be relaxed by MSEDCL to the extent of grid non-availability for evacuation which is beyond the control of the SPV.

This will, however be relaxable by MSEDCL to the extent of grid non- availability for evacuation, which is beyond the control of the Solar Power Generator. The amount of such compensation will be 25% (twenty-five per cent) of the cost of this shortfall in energy terms, calculated at PPA tariff. This compensation shall be applied to the amount of shortfall in generation during the year. However, this compensation shall not be applicable in events of Force Majeure identified under PPA with successful bidder affecting supply of solar power by seller/Solar Power Generator.
Shortfall in minimum generation. During PPA, if for any year, it is found that the developer has not been able to generate minimum energy corresponding to the lower limit of CUF declared by the developer i.e. 1.278 MU/MW/year at the CUF of 16.21 % - (10%) on account of any reasons not attributable to APDCL or Force Xxxxxx events , such shortfall in performance shall make developer liable to pay the compensation provided in the PPA as payable to APDCL This will, however be relaxable by APDCL to the extent of grid non-availability for evacuation, which is beyond the control of the developer. The amount of such penalty will be 25% (twenty-five per cent) of the cost of this shortfall in energy terms, calculated at PPA tariff. This compensation shall be applied to the amount of shortfall in generation during the year. However, this compensation shall not be applicable in events of Force Majeure identified under PPA with trading company affecting supply of wind power by seller/power producer.
Shortfall in minimum generation. 7.2.1 During the term of this PPA, if for any Contract Year, it is found that the SPV has not been able to generate minimum energy corresponding to the value of annual CUF within the permissible lower limit of CUF declared by the SPV, on account of reasons solely attributable to the SPV, such shortfall in energy shall make the SPV liable to pay the penalty equal to INR 4.65 (Indian Rupees Four point Six Five only) per unit of power to MSEDCL. This may, however, be relaxed by MSEDCL to the extent of grid non- availability for evacuation (beyond the Delivery Point) which is beyond the control of the SPV. This penalty shall be applied to the amount of shortfall in supply of energy during the Contract Year.

This will, however be relaxable by MSEDCL to the extent of grid non-availability for evacuation (beyond the Delivery Point), which is beyond the control of the Floating Solar Power Developer. This compensation shall be applied to the amount of shortfall in generation during the Contract Year. However, this compensation shall not be applicable in events of Force Majeure identified under this PPA affecting the supply of Floating Solar Power by Floating Solar Power Developer.

Failure to maintain required insurance shall be a Breach of the Interconnection Construction Service Agreement.
