SITE PLAN AGREEMENT. The following warning clauses may be required to be included in all offers of purchase and sale. The section of Site Plan Agreement that requires the clause is in italics in brackets. The Owner agrees to insert the following clause in the sale and purchase agreement for each dwelling within the Plan; "Students from this area may have to attend existing schools. Although a school site has been reserved in the area of the subject draft plan; a school may not be built for some time, if at all, and then only if the Ministry of Education and Training authorizes funding and construction of this required school." (Schedule E, 1) The Owner agrees to insert a notice in the agreement of purchase and sale for any lot in the advising the purchaser that mail delivery will be from a designated Community Mailbox. The Owner shall be responsible for advising each homeowner in the Plan as to the location of the Community Mailbox to be used by such homeowner. (Schedule E, 4)

SITE PLAN AGREEMENT. The following warning clauses may be required to be included in all offers of purchase and sale, in accordance with the Draft Site Plan Agreement dated October 2, 2023, as may be supplemented, updated and/or revised: • Purchasers/Tenants are hereby advised that sound levels due to increasing road traffic may occasionally interfere with some activities of the dwelling occupants as the sound levels exceed the Ministry of the Environment, Conservation & Park’s noise criteria (Section 31.1). • Purchasers are advised that despite the inclusion of noise control features in the development and/or within the building units, sound levels due to increasing road traffic may on occasions interfere with some activities of the dwelling occupants as the sound levels exceed the Ministry of the Environment, Conservation and Parks’ noise criteria (Section 31.1). • This dwelling unit has been fitted with a forced air heating system and the ducting, etc. was sized to accommodate central air conditioning. Installation of central air conditioning by the occupant will allow windows and exterior doors to remain closed, thereby ensuring that the indoor sound levels are within the Ministry of the Environment, Conservation and Parks’ noise criteria. (Note: The location and installation of the outdoor air conditioning device should be done so as to comply with noise criteria of MECP Publication NPC­216, Residential Air Conditioning Devices, and thus minimize the noise impacts both on and in the immediate vicinity of the subject property.) (Section 31.1). • This dwelling unit has been supplied with a central air conditioning system which will allow windows and exterior doors to remain closed, thereby ensuring that the indoor sound levels are within the Ministry of the Environment, Conservation and Parks’ noise criteria (Section 31.1).
SITE PLAN AGREEMENT. A Permittee may amend its Site Plan Agreement upon agreement between the applicable Permittee, NMFS, and CDFW. Amendments to Site Plan Agreements shall become effective upon the written agreement of NMFS, CDFW, and the Permittee.
SITE PLAN AGREEMENT. The Developer acknowledges and agrees that a site plan agreement shall be required for the Phase 1 VLC as set out in Schedule “M" attached hereto.
