Size and Frequency of Service. This Service shall be provided as 7 deemed necessary and as determined between the CONTRACTOR and the Service Recipient, 8 but such service shall be received no less than one (1) time per week with no exception for 9 holiday(s) as set forth herein, except that Collection Service scheduled to fall on a holiday may 10 be rescheduled as determined between the Service Recipient and the CONTRACTOR as long 11 as the minimum frequency requirement is met. Service may be provided by cart or bin at the 12 option of the Service Recipient. The size of the container and the frequency (above the 13 minimum) of Collection shall be determined between the Service Recipient and the 14 CONTRACTOR. However, size and frequency shall be sufficient to provide that no Recyclable 15 Materials need be placed outside the cart or bin. The CONTRACTOR shall provide containers 16 as part of the Commercial Collection Service rates set forth in Exhibit 1c, however, Service 17 Recipients may own their Compactor provided that the Service Recipient is completely 18 responsible for its proper maintenance and such Compactor shall be of a type that can be 19 serviced by the CONTRACTOR'S equipment.

The Contractor shall not be required to Collect any MFD Solid Waste that is not placed in a Solid Waste Bin or Cart. In the event of non-collection, the Contractor shall contact the Customer to discuss the reason for the non-collection and shall affix to the Solid Waste Bin or Cart a Non- Collection Notice explaining why service was not completed.

Contractor shall provide Solid Waste collection service as deemed necessary and as determined between the Contractor and the customer, but such service shall be received no less than one (1) time per week. Collection service scheduled to fall on a holiday may be rescheduled as determined between the customer and the Contractor as long as the minimum frequency requirement is met. The frequency (above the minimum) of collection shall be determined between the customer and the Contractor. The Contractor shall provide containers as part of the Commercial Collection Services. The kind, size and number of containers furnished to particular customers shall be as determined mutually by the customer and Contractor. Containers which are front loading bins, shall have lids. All containers with a capacity of one cubic yard or more shall meet applicable regulations for container safety and shall have reflective markings, shall be maintained in good repair with neatly and uniformly painted surfaces and shall prominently display the name and telephone number of Contractor. Containers shall be clearly marked and identified as belonging to Contractor. Contractor shall not be obligated to provide customers with compactor units, but will be obligated to charge the rates set by the City for the collection of compacted Solid Waste. The kind, size and number of containers and frequency of collection shall be sufficient to provide that no Solid Waste need be placed outside the container.

The Company shall provide containers,, however, customers may own their Compactor provided that the customer is completely responsible for its proper maintenance and such Compactor shall be of a type that can be serviced by the Company's equipment.

Service may be provided by Garbage Bin, Cart, or Roll-off Container at the option of the Commercial or MFD Service Unit. The size of the container and the frequency of Collection will be determined between the Commercial or the MFD Service Unit and CONTRACTOR. However, size and frequency must be sufficient to provide that no Commercial or MFD Garbage need be placed outside the Bin, Cart or Roll-Off Container. CONTRACTOR must provide containers as part of the Commercial or MFD Collection Service Rates set forth in Exhibit 1, however, Commercial or MFD Service Units may own their Garbage Bin or Roll-Off Containers provided that the Commercial or the MFD Service Unit is completely responsible for its proper maintenance and that such Bin or Roll-Off Container must be of a type that can be serviced by the CONTRACTOR's equipment.

The size of the container and the frequency (above the minimum) of Collection will be determined between the Commercial Service Unit and Contractor. However, size and frequency must be sufficient to provide that no Garbage need be placed outside the Collection Container. Contractor must provide containers as part of the Commercial Collection Service rates set forth in Exhibit 1, however, Commercial Service Units may own their compactor provided that the Unit is completely responsible for its proper maintenance, such bin must be of a type that can be serviced by the Contractor's equipment, and such compactor meets CalRecycle’s container and color requirements.
