Software Updates and Patches. The Supplier takes security extremely seriously. By default all the Supplier servers are configured to check and install the latest critical software updates from Microsoft every day at between 23:00 and 05:00 (GMT) and will reboot the server if necessary. The User may request a change in this time but it is a breach of the Subscription and Service Agreement to disable this feature. Software Updates and Patches n the case of the services provided and operated by xxxxx for the Customer, such as the operating system, middleware, databases or applications, all software updates and/or patches required for reasons of operational security are generally installed independently by xxxxx. If software updates and patches are not or no longer made available by the manufacturer, xxxxx cannot guarantee the operational stability and security. The customer will be informed of this in text form. The customer must then decide how to proceed and notify xxxxx of this in text form through the appropriately authorized persons at the customer.

  • Updates and Upgrades Contractor grants to the Department a non-exclusive, non-transferable license to use upgrades and updates provided by Contractor during the term of the Contract. Such upgrades and updates are subject to the terms of the Contract. The Department shall download, distribute, and install all updates as released by Contractor during the length of the Contract, and Contractor strongly suggests that the Department also downloads, distributes, and installs all upgrades as released by Contractor during the length of the Contract. Contractor shall use commercially reasonable efforts to provide the Department with work-around solutions or patches to reported software problems that may affect the Department’s use of the software during the length of the Contract.

  • Software Warranty We warrant that the Tyler Software will perform without Defects during the term of this Agreement. If the Tyler Software does not perform as warranted, we will use all reasonable efforts, consistent with industry standards, to cure the Defect in accordance with the maintenance and support process set forth in Section C(9), below, the SLA and our then current Support Call Process.
