Sous-traitance. Le Fournisseur pourra sous-traiter l’exécution d’une partie de la Commande sous réserve d’obtenir : (i) l’accord préalable et écrit de l’Acheteur sur le choix du sous-traitant et fournisseur (pour ce faire le Fournisseur xxxxx communiquer à l’Acheteur les références sociales, bancaires ou postales du sous- traitant) et (ii) si applicable, conformément aux stipulations de la loi n°75-1334 du 31 décembre 1975 relative à la sous-traitance, l’acceptation de chaque sous- traitant par le maître de l’ouvrage, ainsi que l’agrément par le maître de l’ouvrage des conditions de paiement relatives à chaque contrat de sous-traitance. Le Fournisseur fera son affaire personnelle de la mise en place, au profit de chaque sous-traitant, des cautions exigées par l’article 14 de la loi n°75-1334 du 31 décembre 1975 relative à la sous-traitance, sans qu’il puisse être reproché à l’Acheteur un défaut de contrôle de la mise en place de ces cautions. Si l’Acheteur ou le Client Final était contraint de régler directement un sous-traitant ou un fournisseur, direct ou indirect, du Fournisseur, l’Acheteur sera autorisé à compenser les sommes ainsi réglées avec celles qu’il resterait devoir au Fournisseur. Le Fournisseur est tenu d’informer ses propres fournisseurs et sous-traitants de toutes dispositions de la Commande s’appliquant à leurs obligations. L’agrément du sous-traitant ne dégage pas le Fournisseur de ses obligations et responsabilités contractuelles vis-à- vis de l'Acheteur. En outre, le Fournisseur informera l’Acheteur de tout sous-traitant ou fournisseur, intervenant pour le compte du Fournisseur : (i) qui détiendrait au sein de son établissement toutes pièces ou composants revêtus de la marque, du logo ou du nom de l’Acheteur, ou de l’une de ses Sociétés Apparentées (ou qui serait responsable de l’inscription de cette marque, de ce logo ou de ce nom) ; (ii) et/ou dont un volume de production de 50 % ou plus serait directement ou indirectement acheté par l’Acheteur.

  • Living Away From Home Allowance When Employees are to be engaged on a Project requiring them to live away from home, the provisions of Appendix I will apply in determining their entitlement and the conditions whilst they are living away from home.
