Space Reclamation. In the event of space exhaust within a Central Office Premises, BellSouth may include in its documentation for the Petition for Waiver filing any unutilized space in the Central Office Premises. ALEC Inc., will be responsible for any justification of unutilized space within its space, if such justification is required by the appropriate state commission.
Space Reclamation. In the event of space exhaust within a Remote Site Location, BellSouth may include in its documentation for the Petition for Waiver filing any vacant space in the Remote Site Location. ALEC Inc., will be responsible for any justification of vacant space within its Remote Collocation Space, if such justification is required by the appropriate state commission.
Space Reclamation. In the event of space exhaust within a BellSouth Premises, BellSouth may include in its documentation for the Petition for Waiver filed with the Commission, any unutilized space in the BellSouth Premises. ComSouth will be responsible for the justification of unutilized space within its Collocation Space, if the Commission requires such justification.
Space Reclamation. 1.5.1 In the event of space exhaust within a BellSouth Premises, BellSouth may include in its documentation for the Petition for Waiver filed with the Commission, any unutilized space in the BellSouth Premises. Neutral Tandem will be responsible for the justification of unutilized space within its Collocation Space, if the Commission requires such justification.
1.5.2 BellSouth may reclaim unused Collocation Space when a BellSouth Premises is at, or near, space exhaustion and Neutral Tandem cannot demonstrate that Neutral Tandem will utilize the Collocation Space in the time frames set forth below in Section 1.5.
Space Reclamation. 1.5.1 In the event of space exhaust within a BellSouth Premises, BellSouth may include in its documentation for the Petition for Waiver filed with the Commission, any unutilized space in the BellSouth Premises. ACCESS Integrated will be responsible for the justification of unutilized space within its Collocation Space, if the Commission requires such justification.
1.5.2 BellSouth may reclaim unused Collocation Space when a BellSouth central office is at, or near, space exhaustion and ACCESS Integrated cannot demonstrate that ACCESS Integrated will utilize the Collocation Space within a reasonable time. In the event of space exhaust or near exhaust within a BellSouth Premises, BellSouth will provide written notice to ACCESS Integrated requesting that ACCESS Integrated release non-utilized Collocation Space to BellSouth, when one hundred percent (100%) of the Collocation Space in ACCESS Integrated’s collocation arrangement is not being utilized.
1.5.3 Within twenty (20) days of receipt of written notification from BellSouth, ACCESS Integrated shall either: (1) return the non-utilized Collocation Space to BellSouth, in which case ACCESS Integrated shall be relieved of all obligations for charges associated with that portion of the Collocation Space applicable from the date the Collocation Space is returned to BellSouth; or (2) for all states, with the exception of Florida, provide BellSouth with information demonstrating that the Collocation Space will be utilized within twenty-four (24) months from the date ACCESS Integrated accepted the Collocation Space (Acceptance Date) from BellSouth. For Florida, ACCESS Integrated shall provide information to BellSouth demonstrating that the Collocation Space will be utilized within eighteen
Space Reclamation. In the event of space exhaust within a central office premises, Network Telephone may be required to release space to BellSouth to be allocated to other physical collocation applicants when a minimum of fifty percent of the total amount of space in Network Telephone’s collocation arrangement is not being utilized within the first year of operation, or 100% of the total amount of space by the end of the second year of operation.
Space Reclamation. In the event of space exhaust within a BellSouth Premise, BellSouth may include in its documentation for the Petition for Waiver filed with the Commission, any unutilized space in the BellSouth Premise, including unutilized space held by GulfPines and other collocated telecommunications carriers in BellSouth’s Premise. GulfPines will be responsible for the justification of unutilized space within its Collocation Space, if the Commission requires such justification.
1.4.1 If physical Collocation Space is needed to accommodate another telecommunication carrier’s request for physical collocation or BellSouth’s own immediate space needs, BellSouth may reclaim from GulfPines any physical Collocation Space that is not being “efficiently used” or that cannot be proven to be needed within the two (2) year (18 months in Florida) planning period. This term (efficiently used) shall mean that substantially all of the floor space is taken up by GulfPines’ collocated equipment as described in Section 5.1 of this Attachment. In addition, BellSouth may reclaim, for the same reasons as those stated above, any space that is not being used at all to house GulfPines’ equipment and/or facilities for collocation purposes. GulfPines will have one hundred eighty (180) calendar days from receipt of notice by BellSouth to GulfPines of the need for such physical Collocation Space to ensure that such space is being used in accordance with the terms and conditions herein and shall be responsible to justify to the Commission, if the Commission requires such justification.

DukeNet will be responsible for any justification of unutilized space within its Remote Collocation Space, if the Commission requires such justification.
