Spousal Power of Appointment. Settlor hereby grants to her spouse, Xxxxxx Xxxxxx Xxxxx, a general power to appoint to the SEM Family Trust, settled on the death of Xxxxxx Xxxxxx Xxxxx under the terms of the Xxxxxx Xxxxxx Xxxxx Trust u/d/t 06/29/2011, the following, namely, up to that value of the Trust Property equal to any unused amount of the federal estate tax exemption available to the estate of Xxxxxx Xxxxxx Xxxxx upon his death. To be effective, this power of appointment must be exercised by specific reference thereto in the last will and testament of Xxxxxx Xxxxxx Xxxxx that is admitted to probate by a court of competent jurisdiction.
