Staffing New Stores or a Replacement Store. If the Employer transfers employees from one Contract Area to another for the purpose of staffing a New or Replacement Store, such employees shall hold the seniority they had immediately prior to being transferred to the New Store. At the end of one (1) calendar week after the store has opened, a seniority list will be prepared showing the seniority of the various employees which shall then become the seniority list in the new Contract Area. A copy of such list shall be posted in the store. The term "New Store" shall also be taken to mean a "remodel" where the size of the store is increased. Employees transferring to a New or Replacement Store shall have their seniority date amended to reflect their seniority date held in their previous Contract Area. In the case of New Store openings where two (2) or more employees commence work on the same date, their seniority shall be determined at the end of sixty (60) days. At the end of the sixty (60) day period after the store opening, the seniority dates of transferred and newly hired employees will be sent to the Union office. The Employer agrees that employees will only be transferred from one bargaining area to another with their consent.

Full-time employees permanently transferred out of the area of this Collective Agreement will resume their seniority rights in the area up to their original date of transfer if transferred back to the area within twelve (12) months.
