Innovative Unit Scheduling. Schedules other than those included in Articles 13.01 and 13.02 may be developed in order to improve quality of working life, support continuity of patient care, ensure adequate staffing resources, and support cost-efficiency. The parties agree that such innovative schedules may be determined locally by the Hospital and the Union subject to the following principles:
(a) Such schedules shall be established by mutual agreement of the Hospital and the Union;
(b) These schedules may pertain to full-time and/or part-time nurses;
(c) The introduction of such schedules and trial periods, if any, shall be determined by the local parties and recorded in the Appendix of Local Provisions. Such schedules may be discontinued by either party with notice as determined within the Appendix of Local Provisions;
(d) Upon written agreement of the Hospital and the Union, the parties may agree to amend collective agreement provisions to accommodate any innovative unit schedules.

A unit weekend schedule may be developed in order to meet the Hospital’s need for weekend staff, and individual nurses’ preference for a weekend work schedule. A unit weekend schedule is defined as a schedule in which a full-time nurse works a weekly average of thirty (30) hours and is paid for hours at her or his regular straight time hourly rate. The schedule must include two hour tours, which within a weekend period as by the Hospital and the Association. A nurse working a weekend schedule will work every weekend except as provided for in the provisions below. If the Hospital and the Association agree to a unit weekend schedule, the introduction of that schedule and the manner in which the are filled, shall be determined by the local parties and recorded in the Appendix of Local Provisions. This unit schedule may be discontinued by either party with notice as determined within the Appendix of Local Provisions. The opportunity for an individual nurse to discontinue this schedule shall be resolved by the local parties:
Innovative Unit Scheduling. 2 Day, 2 Night Followed by 5 Days Off
1. The Parties agree that groups of three (3) full-time nurses to a maximum of nine (9) or multiples of nine (9) will be allowed to participate in the trial. If more than nine (9) nurses or a number other than multiples of three (3) indicate an interest, selection will be based on seniority.
2. The parties agree that the following shift combinations are allowed to be scheduled and are defined as follows: Definition – D = 07:00 to 19:00, LD = 09:00 to 21:00 and N = 19:00 to 07:00 Schedule – D D N N, D LD N N.
3. If at any time a nurse involved in the “2 Day/2 Night” rotation is unable to continue for such reasons as medical, family emergencies, etc., the nurse will promptly bring this to the attention of the Manager and the Union. The parties will then meet to discuss accommodating the nurse’s withdrawal from the “2 Day/2Night” rotation and finding a replacement. If the operation of the Emergency Department is negatively impacted as a result of one of more nurses withdrawing the Hospital reserves the right to discontinue the trial.
4. For those nurses working the “2 Day/2 Night” rotation, the scheduling provisions contained in Article F-9 (g) of the collective agreement are not applicable, save and except for the following:
(a) Nurses shall not be required to work more than four (4) consecutive extended tours. Where the schedule does not conform to this provision, nurses shall be paid premium pay in accordance with Article 14.03, for the fifth and subsequent tour(s), until the nurse receives a day off save and except where:
i) The fifth (5th) extended tour is worked to satisfy specific requested days off requested by the employee; or,
ii) The fifth (5th) extended tour is the result of an exchange with another employee.
(b) The innovative unit schedule “2 Day/2 Night” for full-time nurses will not adversely affect the schedules of other nurses in the unit in such a way as to cause a scheduling violation under the provisions of the collective agreement.
(c) The innovative unit scheduling “2 Day/2 Night” will be done on the basis that each full-time nurse will be scheduled for 1950 hours per year.
(d) Full-time employees working the “2 Day/2 Night” schedule shall be scheduled for additional tours necessary to satisfy the 1950 paid hours per year requirement in any calendar year. Innovative Unit Scheduling. Innovative schedules other than those currently provided for in the Appendix 5 of Local provisions and which fall under Article 13.03 of the central portion of the Collective Agreement will not be implemented on any unit prior to discussion with and the written agreement of the Union. All parameters related to the introduction, discontinuation, voting process, trial periods and scheduling will be agreed upon on writing.

A variety of work schedules may be introduced on a unit-by-unit basis, provided that the required ratio of paid rest periods and unpaid meal breaks in relation to the total length of the shift or “face time” is not violated. “Face time” is defined as the total number of hours, both paid and unpaid, making up the total nursing tour. For greater clarity, a standard tour of 7.5 paid hours consists of eight (8) hours of face time, and includes two paid rest periods of fifteen (15) minutes duration and one unpaid meal break of thirty (30) minutes duration. The parties agree that such innovative schedules may be determined by the Employer and the Union using the model agreement outlined at Article 28 subject to the following principles:
i) Such posted schedules shall be established by mutual agreement of the Employer and the Union;
ii) These posted schedules may pertain to full-time and/or part-time employees;
iii) The terms of the innovative schedule will be agreed to by the Employer and the Union in the model agreement outlined at Article 28.
iv) Upon written agreement of the Employer and the Union, the parties may agree to amend the collective agreement provisions to accommodate any innovative unit schedules.
