State Authority. Except as expressly provided herein, nothing in this Agreement shall be construed to limit, restrict, or modify the DHCS’ powers, authorities, and duties under Federal and State law and regulations.
State Authority. The relief provided in this Settlement Agreement, including all payments by ACCCH or by the Ameriquest Parties, to the Settlement Fund or any accounts established by this Settlement Agreement, is in response to and in compliance with each Settling State’s authority to regulate ACCCH and the Ameriquest Parties and each of the Settling States’ police powers.
State Authority. If, and to the extent that, water rights asso- ciated with the Xxxx Xxxxx Xxxx Xxxxx No. 4 are acquired, the use of those water rights shall be changed only in accordance with the laws of the State of Colorado.
State Authority. The State is granted authority, pursuant to Section 14(C) of Article VII of the Louisiana Constitution of 1974, as amended, to enter into cooperative endeavor agreements with public and private associations or corporations for a public purpose, including agreements which may require the use of State funds, personnel or other resources, provided legal guidelines are met and the Project Benefits are demonstrated to be commensurate with or greater than the investment of funds by the State. This Agreement is entered into with the expectation and belief that during the Term, the Project Benefits from each Project will exceed the obligations of the State under the applicable Ancillary Agreements for the respective Project, including the State Investment thereunder.
State Authority. The Permittee agrees that the issuance of this permit shall in no way diminish the statutory authority of the State University of New York or the University to possession, pursuant to the Education Law, of the State controlled property to which this permit relates; nor shall the dominion and control by the State University of New York over the said State property be in any way diminished.
State Authority. A State may not enter into an agreement under this subsection unless the State enacts a law after March 23, 2010, that specifically au- thorizes the State to enter into such agree- ments.

State Authority. 1. The State has concurrent jurisdiction to tax certain transactions involving non- members of the Tribe occurring on the Turtle Mountain Reservation.
2. The State may, under North Dakota Century Code Chapter 54-40.2, enter into agreements with Native American Tribes.
3. Specific to this Agreement, the parties agree that the State has concurrent jurisdiction with the Tribe to impose its Motor Vehicle Fuel tax and Special Fuel tax on fuel purchases made by non-members of the Tribe occurring within the exterior boundaries of the Turtle Mountain Reservation.
State Authority a. Except as provided in Section C., D., and E., of this Article IV and Section B.3. of Article VII, the State shall administer and enforce all water rights Arising Under State Law to the use of surface water and Groundwater.
b. The State shall administer and enforce water rights set forth in Section E. of Article III on Tribal trust and fee land for use in the portion of the Missouri Basin 40EJ and Peoples Creek Basin 40I off the Reservation unless Congress acts to modify the Reservation boundary to include the Tribal trust and fee land. In administering the Tribal water rights on trust and fee land off the Reservation in Basins 40EJ and 40I, the State shall treat the Tribal rights as water rights Arising Under State Law except that non-use of all or any of the Tribal water rights off the Reservation in Basins 40EJ and 40I shall not constitute a relinquishment, forfeiture, or abandonment of such rights.
