Status Pending Good Faith Belief Test Results. Employees tested for Alcohol and/or Drugs based on Good Faith Belief shall be suspended without pay pending the Agency’s receipt of the screening or confirmatory Alcohol test results and/or the MRO’s verified report for Drugs and/or the MRO’s report of any additional analysis requested by the employee under Paragraph D.4 of this Section III, above. If the screening or confirmatory Alcohol test result and/or the MRO Drug test report and/or the report of any additional analysis requested by the employee pursuant to Paragraph D.4 of this Section III, above is/are verified as negative, the employee will be returned to work and receive back pay for all scheduled days and hours of work actually lost. The only exceptions to this policy is in the case of an employee who causes a delay in the completion of the MRO’s report because of their failure to provide the specimen collection facility, the MRO and the Agency with a means to contact them and/or failure to contact the MRO upon notification by the MRO or the Head of Human Resources to do so. In such case(s), the employee will not be paid for lost work time attributable to their own failure to provide such means of contact and/or failure to contact the MRO as requested.

  • STATEWIDE ACHIEVEMENT TESTING When CONTRACTOR is an NPS, per implementation of Senate Bill 484, CONTRACTOR shall administer all Statewide assessments within the California Assessment of Student Performance and Progress (“CAASP”), Desired Results Developmental Profile (“DRDP”), California Alternative Assessment (“CAA”), achievement and abilities tests (using LEA-authorized assessment instruments), the Fitness Gram with the exception of the English Language Proficiency Assessments for California (“ELPAC”) to be completed by the LEA, and as appropriate to the student, and mandated by XXX xxxxxxxx to LEA and state and federal guidelines. CONTRACTOR is subject to the alternative accountability system developed pursuant to Education Code section 52052, in the same manner as public schools. Each LEA student placed with CONTRACTOR by the LEA shall be tested by qualified staff of CONTRACTOR in accordance with that accountability program. XXX shall provide test administration training to CONTRACTOR’S qualified staff. CONTRACTOR shall attend LEA test training and comply with completion of all coding requirements as required by XXX.

  • Positive Test Results In the event an employee tests positive for drug use, the employee will be provided, in writing, notice of their right to explain the test results.
