Study Recordings. The Orchestra may be scheduled to rehearse and record a Work Recording of a new opera score, commissioned by the COC. The Work Recording shall be used only for preparatory review and planning by the Composer, Librettist, Director, Choreographer, Cast, or other members of the Creative Staff for the new opera and shall be strictly controlled by the COC for non-commercial and non-promotional use. Rehearsals and recording sessions shall be paid according to Article 3 and may be deducted from available unused guarantee services. For clarity, a study recording cannot be made from a rehearsal service; the recording must constitute a service separate from any rehearsal service. The recording must take place within a mini-season and not during any dark period for the orchestra. Conditions and compensation for any use other than the purposes expressly set out above are to be negotiated with the TMA and/or AFM and, to the extent applicable, are subject to any existing AFM agreement.

Study Recordings. Rehearsals and concerts may be recorded (with respect to their audio or visual components or both) by Symphony Management without payment to Orchestra Musicians for study purposes. These recordings shall remain at all times in the custody of Symphony Management except when disseminated to Orchestra Musicians upon request during normal business hours. Beginning with the 2011-2012 season, each recording shall be catalogued by number and according to content in a written log maintained by Symphony Management. All Orchestra Musicians obtaining access to, or copies of, such recordings, shall be obligated to return, without preserving copies, such recordings. Symphony Management may also, on behalf of the music director or guest artists, record rehearsals and concerts for study purposes. Recordings shall not be used in any dismissal, demotion, or disciplinary proceeding. Musicians may, after providing twenty-four (24) hours’ notice by written communication to both the Orchestra Committee and Symphony Management, record rehearsals for study purposes.
Study Recordings. (A) Making of Study Recordings For the sole purpose of review by Artists engaged as Understudies, Covers, Fight Captains or Dance Captains a recording of specific elements of a production may be made by the Engager during a regularly scheduled rehearsal. The Artists shall be notified of such recording no later than the end of the previous day. No special call or additional rehearsal to facilitate this recording is allowed. The Engager may make duplicate copies of this recording to lend to the Artists. The Engager retains the full responsibility for any potential misuse of such recording. The Engager shall ensure that the original recording and all copies are returned to the Engager by the conclusion of the production, and subsequently destroyed.

  • Recordings The Client and the Service Provider consent to telephonic or electronic recordings for security and quality of service purposes and agree that either may produce telephonic or electronic recordings or computer records as evidence in any proceedings brought in connection with this Agreement.

  • Telephone Recordings I understand and agree that any telephone conversation with You will or may be recorded for accuracy and I consent to such recording.

  • Regulatory Filings NYISO and Connecting Transmission Owner shall file this Agreement (and any amendment hereto) with the appropriate Governmental Authority, if required. Any information related to studies for interconnection asserted by Developer to contain Confidential Information shall be treated in accordance with Article 22 of this Agreement and Attachment F to the ISO OATT. If the Developer has executed this Agreement, or any amendment thereto, the Developer shall reasonably cooperate with NYISO and Connecting Transmission Owner with respect to such filing and to provide any information reasonably requested by NYISO and Connecting Transmission Owner needed to comply with Applicable Laws and Regulations.

  • Photographic/Recording Release I hereby grant and convey unto the Released Parties all right, title and interest in any and all photographs and video/audio/electronic recordings of me, including as to my name, image and voice, made by or on behalf of any of the Released Parties during my Activities with the Released Parties, including, but not limited to, the right to use such materials for any purpose and to any royalties, proceeds or other benefits derived from them. I understand that I will not have any ownership interest in or to such photographs, images and/or recordings, I have not been provided or promised any compensation to me, and I hereby waive any rights, privileges or claims based on any right of publicity, privacy, ownership or any other rights arising, relating to or resulting from the photographs, images and/or recordings. I understand and agree that this paragraph also applies to my minor child(ren) who are volunteering.

  • Studies The clinical, pre-clinical and other studies and tests conducted by or on behalf of or sponsored by the Company or its subsidiaries that are described or referred to in the Registration Statement, the Pricing Disclosure Package and the Prospectus were and, if still pending, are being conducted in accordance in all material respects with all statutes, laws, rules and regulations, as applicable (including, without limitation, those administered by the FDA or by any foreign, federal, state or local governmental or regulatory authority performing functions similar to those performed by the FDA). The descriptions of the results of such studies and tests that are described or referred to in the Registration Statement, the Pricing Disclosure Package and the Prospectus are accurate and complete in all material respects and fairly present the published data derived from such studies and tests, and each of the Company and its subsidiaries has no knowledge of other studies or tests the results of which are materially inconsistent with or otherwise call into question the results described or referred to in the Registration Statement, the Pricing Disclosure Package and the Prospectus. Except as described in the Registration Statement, the Pricing Disclosure Package and the Prospectus, neither the Company nor its subsidiaries has received any notices or other correspondence from the FDA or any other foreign, federal, state or local governmental or regulatory authority performing functions similar to those performed by the FDA with respect to any ongoing clinical or pre-clinical studies or tests requiring the termination or suspension of such studies or tests. For the avoidance of doubt, the Company makes no representation or warranty that the results of any studies, tests or preclinical or clinical trials conducted by or on behalf of the Company will be sufficient to obtain governmental approval from the FDA or any foreign, state or local governmental body exercising comparable authority.

  • Time Recording The instrumentation shall enable the action to be recorded throughout its duration and readings to be made to within one one-thousandth of a second; The beginning of the impact at the moment of first contact between the headform and the item being tested shall be detected on the recordings used for analysing the test.
