Supplier Not an Agent. LESSEE UNDERSTANDS AND AGREES THAT (i) NEITHER THE SUPPLIER, NOR ANY SALES REPRESENTATIVE OR OTHER AGENT OF THE SUPPLIER, IS (1) AN AGENT OF LESSOR OR (2) AUTHORIZED TO MAKE OR ALTER ANY TERM OR CONDITION OF THIS LEASE, AND (ii) NO SUCH WAIVER OR ALTERATION SHALL VARY THE TERMS OF THIS LEASE UNLESS EXPRESSLY SET FORTH HEREIN.

Supplier Not an Agent. Lessee understands and agrees that neither Supplier, nor any salesman or other agent of Supplier is an agent of Lessor, and that Lessor is not an agent of Supplier. No salesmen or agent of Supplier is authorized to waive or alter any term or condition of this lease, and no representation as to Equipment or any other matter by Supplier shall in any way affect Lessee's duty to pay the rent, and perform its other obligations as set forth in this lease.

Supplier Not an Agent. Lessee further understands and agrees that neither the Supplier, nor any sales representative or agent of the Supplier, is an agent or employee of Nexseer. Sales representatives of the Supplier, persons not employed by Nexseer (including, without limitation, brokers) or by any Nexseer personnel who is not a duly authorized signer of a Lease are not authorized to waive or alter any term or condition of a Lease. Only a duly authorized signer of a Lease may waive or alter any term or condition of a Lease. No representation as to the Equipment by the Supplier, by any person not employed by Nexseer or by any Nexseer personnel who is not a duly authorized signer of a Lease shall in any way bind Nexseer or affect Lessee's obligations under a Lease.

  • Supplier A manufacturer, fabricator, distributor, supplier, or vendor of goods or equipment in connection with the Work, or any other party having a Contract or Purchase Order with the Contractor or with a Subcontractor to furnish materials or equipment to be incorporated in the Work by the Contractor or a Subcontractor.

  • End Users Customer will control access to and use of the Products by End Users and is responsible for any use of the Products that does not comply with this Agreement.
