Sustainable Transport Contribution. To pay the Sustainable Transport Contribution to the County Council prior to the Commencement Date
Sustainable Transport Contribution. 2.1 To pay the Sustainable Transport Contribution into a separately identified interest-bearing section of the County Council's combined accounts as soon as reasonably practicable.
2.2 Not to use any part of the Sustainable Transport Contribution other than towards the cost of enhancing the existing footway/cycle infrastructure in the vicinity of the Site along the A6 Garstang Road corridor within Xxxxxx village and between Xxxxxx and Xxxxxxxxx.
2.3 In the event that the Sustainable Transport Contribution has not been spent or committed for expenditure by the County Council within 5 years following the date of receipt of the payment of the Sustainable Transport Contribution the County Council shall refund to the party who paid it any part of the Sustainable Transport Contribution which has not been spent or committed for expenditure, together with any accrued interest.
Sustainable Transport Contribution. To pay to the County Council acting as the relevant transport authority the Sustainable Transport Contribution Index Linked in two equal instalments as follows:
Sustainable Transport Contribution. Not to use any part of the Sustainable Transport Contribution other than for the purpose of [ towards improving sustainable transport infrastructure in the area which forms part of the wider LCC A6 Traffic Management Strategy, including slip road improvement works at the M55 Junction
Sustainable Transport Contribution. 7.1 The County Council covenants with the Developer to notify the Developer and to keep the Developer notified of the costs of the New Hall Lane Junction Works (including the costs of the completed New Hall Lane Junction Works).
7.2 Unless the Developer has carried out and completed the New Hall Lane Junction Works the County Council will be entitled to serve written notice on the Developer (an STC Notice) requiring payment of part or all of the Sustainable Transport Contribution provided that:
(a) no STC Notice will be served before the date on which the Development is first Occupied or after the date on which is 5 (five) years from the date which the Development is first Occupied;
(b) each STC Notice will state clearly the works or measures on which the County Council proposes to spend the Sustainable Transport Contribution and the timescale for doing so and will state the spatial or functional relationship of those works or measures to the Development and its impacts; and
(c) the County Council will provide such information as the Developer may reasonably require in relation to the use of any monies paid pursuant to an STC Notice.
Sustainable Transport Contribution. 4.1 To pay the Sustainable Transport Contribution to the County Council prior to the Commencement Date.
4.2 Not to Commence the Development until the Sustainable Transport Contribution has been paid in accordance with paragraph 4.1 of this Schedule.
Sustainable Transport Contribution. To pay the Sustainable Transport Contribution to the County Council prior to the Commencement of the Development and not to Commence Development until the Sustainable Transport Contribution has been paid to the County Council.
Sustainable Transport Contribution. 2.1.1 To pay the Sustainable Transport Contribution to the County Council prior to first Occupation of the Development; and
2.1.2 Not to first Occupy or permit first Occupation of the Development until the Sustainable Transport Contribution has been paid in accordance with paragraph 2.1.1 of this Part 2 of this Schedule. 1 In this Schedule 7, the following expressions shall have the following meanings and the definitions set out in Schedule 1 shall also apply: Additional Affordable Housing Amount means additional Affordable Housing which a Viability Review demonstrates can be viably delivered within the Development in addition to any previously agreed or determined Affordable Housing provision as set out in Schedule 1 of this Agreement provided always that any increase including any Additional Affordable Housing Contribution or Late Stage Review Contribution shall not take the overall delivery of Affordable Housing in the Development beyond the Affordable Housing Cap;
Sustainable Transport Contribution. The Owner for themselves and their successors in title and assigns hereby jointly and severally covenant with the Council as follows:-
Sustainable Transport Contribution. 4.1 The Council covenants with the Developer that if the Sustainable Transport Contribution is paid to apply such contributions only towards sustainable transport measures on the Site or in the vicinity of the Site.
