Viability Review definition

Viability Review means a review to be provided by the Owner and Developer assessing the ability of the Development to viably deliver some or all of the Deferred Affordable Housing or a requirement for a Revised Affordable Housing Scheme based upon a review of relevant income assumptions undertaken VIABILITY REVIEWThree months prior to the Implementation of the Development the Owner and/or Developer shall undertake a Viability Review and submit the same to the District Council which shall be accompanied by:-either:- the Relevant Report; ora Revised Affordable Housing Scheme; ora Deferred Affordable Housing Payment proposal; ora Deferred Affordable Housing Scheme (together the "Accompanying Documents").VALIDATION OF VIABILITY REVIEW AND REQUESTS FOR FURTHER INFORMATIOnThe Owner and/or the Developer shall allow the District Council a minimum of 28 Working Days to consider the Viability Review and Accompanying Documents and if it chooses to do so to either:confirm in writing to the Owner or Developer that it has received a valid Viability Review and the necessary Accompanying Documents ("Validation Date"); orrequest such further financial, planning, legal or other information as acting reasonably it deems necessary in order to assess viability.In the event that the District Council does not issue a response within the period.REVIEW OF VIABILITY REVIEW AND DEFERRED AFFORDABLE HOUSING SCHEMEFor a period not exceeding 2 (two) calendar months commencing on the Validation Date (unless otherwise agreed with the District Council in writing), the Owner and/or Developer and the District Council (or its surveyor) may review and seek to agree:-
Viability Review means the upwards only review of the financial viability of the Development using Formula 1a to determine whether an Affordable Housing Contribution is payable;
Viability Review means any review of a Viability Assessment by the Borough Council's Assessor in accordance with Part 2 of Schedule 2 to this Deed with the purpose of dete rmining the viability of the Relevant Balance of the Development (as applicable to the respective Viability Assessment) in order to calculate whether any Surplus exists and is to be applied to Defen-ed Affordable Housing Units and/or Deferred Contributions and/or recovery ofHIF Funding and the amount of such provision or payment;
