Swiss Personal Data. In relation to Personal Data that is protected by the Swiss Federal Act on Data Protection, the EU SCCs will apply amended and adapted as follows:

Swiss Personal Data. In accordance with guidance issued by the Swiss Federal Data Protection and Information Commissioner (FDPIC), the parties hereby agree to adopt the EU SCC as adapted herein in order to comply with Swiss legislation and thus be suitable for ensuring an adequate level of protection for data transfers from Switzerland to a third country in accordance with Article 6 paragraph 2 letter a of the Federal Act on Data Protection (“FADP”). To the extent there is any conflict between the DPA and this Section 6.3, the terms of this section will prevail in relation to Swiss Personal Data. The parties agree that in relation to Restricted Transfer of Swiss Personal Data, Section 8.3 applies except:
Swiss Personal Data. Where Customer is located in Switzerland, the version of the SCCs referenced in Part A, Section 12(d) above shall apply and shall include all necessary amendments to make them legally effective in Switzerland, including but not limited to the following:

  • Personal Data Registry Operator shall (i) notify each ICANN-­‐accredited registrar that is a party to the registry-­‐registrar agreement for the TLD of the purposes for which data about any identified or identifiable natural person (“Personal Data”) submitted to Registry Operator by such registrar is collected and used under this Agreement or otherwise and the intended recipients (or categories of recipients) of such Personal Data, and (ii) require such registrar to obtain the consent of each registrant in the TLD for such collection and use of Personal Data. Registry Operator shall take reasonable steps to protect Personal Data collected from such registrar from loss, misuse, unauthorized disclosure, alteration or destruction. Registry Operator shall not use or authorize the use of Personal Data in a way that is incompatible with the notice provided to registrars.

  • Processing Personal Data 40.1. The Company is the data controller in the relevant jurisdiction. You hereby acknowledge and agree to the collection and processing of personal data provided by you in connection with the opening of a trading account for the purpose of performing our obligations under these Terms and Conditions and for administering the relationship between you and us.
