5.1.7 The part commissioning of the project may be accepted by MSEDCL subject to the condition that minimum capacity for acceptance of first and subsequent part commissioning shall be 2 MW.
5.1.8 The early commissioning of solar power project is permitted for full commissioning as well as part commissioning. In case of early full commissioning, MSEDCL will purchase the generation till SCOD at PPA tariff. In case of part commissioning till SCOD as described in Section 5.1.7, MSEDCL will purchase the generation till SCOD at 75% of PPA tariff. Irrespective of the dates of the part commissioning or full commissioning, the PPA will remain in force for a period of 25 (Twenty five) years from the SCoD.

5.1.5 The SPG BESSD shall commission the Project as detailed in “Schedule 3: Commissioning Procedure” within nine eighteen (918) Months from of the Effective Date of execution of this PPABESPA. 5.1.6 Part commissioning of the Project, without imposition of any liquidated damages in terms of the BESPA, shall be accepted by NVVN subject to the condition that the minimum part commissioning capacity for the 1st part will be 50 MW. The total number of instalments in which a Project can be commissioned will be not more than 3, i.e., 1st initial instalment of 50 MW and 2 subsequent instalments. However, the SCD will not get altered due to part commissioning. Irrespective of dates of part commissioning or full commissioning, the BESPA will remain in force for the Term as defined in this Agreement.
5.1.7 The Parties agree that for the purpose of commencement of the supply of electricity XXXX capacity by SPG the BESSD to PGVCLNVVN, liquidated damages for delay etc., the Scheduled Commissioning Date (or extended Scheduled Commissioning Date) as defined in this Agreement shall be the relevant date.

Synchronization, Commissioning and Commercial Operation. 5.1.1 The SPG shall give PGVCL UGVCL at least thirty (30) days’ advanced preliminary written notice and at least fifteen (15) days’ advanced final written notice, of the date on which it intends to synchronize the Solar Power Project to the Grid System.
5.1.2 Subject to Article 5.1.1, the Power Project may be synchronized by the SPG to the Grid System when it meets all the connection conditions prescribed in applicable Grid Code then in effect and otherwise meets all other Indian legal requirements for synchronization to the Grid System.
5.1.3 The synchronization equipment and all necessary arrangements / equipment including RTU for scheduling of power generated from the Project and transmission of data to the concerned authority as per applicable regulation shall be installed by the SPG at its generation facility of the Power Project at its own cost. The SPG shall synchronize its system with the Grid System only after the approval of synchronization scheme is granted by the head competent authority of the concerned substation/ and checking/verification is made by the concerned authorities of the PGVCLUGVCL.
5.1.4 The SPG shall immediately after each synchronization/tripping of generator, inform the sub-station of the Grid System to which the Power Project is electrically connected in accordance with applicable Grid Code. In addition, the SPG will inject in-firm power to grid from time to time to carry out operational/ functional test prior to commercial operation. For avoidance of doubt, it is clarified that Synchronization / Connectivity of the Project with the grid shall not to be considered as Commissioning of the Project.
5.1.5 The SPG shall commission the Project within nine (9) Months from the Date of execution of this PPA. Declaration of COD shall be certified by the commissioning committee.
5.1.6 The Parties agree that for the purpose of commencement of the supply of electricity by SPG to PGVCLUGVCL, liquidated damages for delay etc., the Scheduled Commissioning Date as defined in this Agreement shall be the relevant date.

5.1.7 The part commissioning of the project may be accepted by MSEDCL subject to the condition that minimum capacity for acceptance of first and subsequent part commissioning shall be 2 MW.
5.1.8 The early commissioning of solar power project is permitted for full commissioning as well as part commissioning. In case of early full commissioning, MSEDCL will purchase the generation till SCOD at PPA tariff. In case of part commissioning till SCOD as described in Section 5.1.7, MSEDCL will purchase the generation till SCOD at 75% of PPA tariff. Irrespective of the dates of the part commissioning or full commissioning, the PPA will remain in force for a period of 25 (Twenty five) years from the SCoD.

Declaration of COD / UCOD shall only be certified done subject to the demonstration of the compliances as per Schedule-6 and subsequent upon the successful visit by the commissioning committeeCommissioning Committee.

5.1.5 The SPG SPD shall commission the Project within nine [Insert 18 (9Eighteen) Months from as per RFS] of the Date of execution of this PPA. Declaration of COD shall be certified by the commissioning committeeEffective Date.
5.1.6 There can be part Commissioning of the project. Part Commissioning of the project shall mean that all equipments corresponding to the part capacity have been installed and commissioned and corresponding energy has flown into the grid. The first part commissioning and subsequent part commissioning shall be for a minimum of 50 MW capacity of the Solar PV Capacity (AC MW) of the station.
5.1.7 The Parties agree that for the purpose of commencement of the supply of electricity by SPG SPD to PGVCLNHPC, liquidated damages for delay etc., the Scheduled Commissioning Date as defined in this Agreement shall be the relevant datedate and not the COD, as defined in the Agreement. The COD is relevant for considering the duration of the Agreement and for the period upto which the Performance Bank Guarantee shall be required to be maintained by the SPD under this Agreement.
