Early Commissioning. The BESSD shall be permitted for full commissioning as well as part commissioning of the Project even prior to the Scheduled Commissioning Date. Early commissioning of the Project will be allowed solely at the risk and cost of the BESSD, and SECI may purchase the XXXX capacity from such early commissioned Project at BESPA tariff, only in the case Discom agrees to purchase XXXX Capacity at an earlier date at BESPA tariff plus facilitation charges in the form of trading margin under BESSA. Such intimation for early commissioning shall be provided to SECI at least 15 days before the proposed early commissioning date as per the Commissioning Procedure. In case there is no response provided by SECI within 7 days from the receipt of such intimation, such early commissioned capacity shall be deemed to have been rejected by SECI. In case SECI does not agree to purchase such capacity, early part/full commissioning of the Project shall still be allowed and the BESSD will be free to sell such capacity to a third party at its own risk and cost; until SCD or the date of commencement of procurement of XXXX Capacity notified by SECI, whichever is earlier. In such cases, a Provisional Commissioning Certificate will be issued to BESSD for period up to SCD or date of commencement of Power Procurement (whichever is earlier), along with a NOC for sale of Power to 3rd Party for such period. UCOD/COD of the Project under the BESPA will be the date on which the commissioning certificate is issued upon successful commissioning of the part/full capacity of the Project. Subject to the provisions of this Agreement, in case of early commissioning, if BESSD sells any capacity to a third party, the BESSD will have to again demonstrate 100% of Contracted Capacity (as per the Commissioning Procedure) to the Procurer from the date of commencement of off-take of capacity by the Procurer.
Early Commissioning. The WPD shall be permitted for full commissioning as well as part commissioning of the Project even prior to the Scheduled Commissioning Date, subject to availability of transmission connectivity and Long-Term Access (LTA). Early commissioning of the Project will be allowed solely at the risk and cost of the WPD, and SECI shall purchase the energy from such early commissioned Project at the PPA tariff, only in case the Discom agrees to purchase power from the Project at an earlier date, and at the PPA tariff plus trading margin. In cases of early (part or full) commissioning, the WPD shall be required to intimate SECI its proposed date of early commissioning not later than 60 days prior to the proposed commissioning date. SECI shall respond to the WPD not later than 30 days from receipt of the above intimation, regarding its acceptance or refusal to purchase such power from the proposed early commissioning date. In case SECI does not agree to purchase such energy, early part/full commissioning of the Project shall still be allowed and the WPD will be free to sell such energy to a third party; subject to operationalization of LTA, until SCD or the date of commencement of procurement of power from the Project as notified by SECI, whichever is earlier. COD of the Project under the PPA will be declared from the date of commencement of procurement of energy from the Project by SECI.
Early Commissioning. The SPD shall be permitted for full commissioning as well as part commissioning of the Project even prior to the Scheduled Commissioning Date, subject to availability of transmission connectivity and GNA. Early commissioning of the Project will be allowed solely at the risk and cost of the SPD, and NTPC may purchase the energy from such early commissioned Project at the rate of 75% (seventy-five percent) of the PPA tariff. While calculating the above value of 75% of the PPA tariff, the digits after 2 decimal places will be ignored. For e.g., in case the value of 75% of the PPA tariff is calculated as 2.4567/kWh, the tariff applicable for purchase in case of early commissioning will be read as Rs. 2.45/kWh. Such intimation for early commissioning shall be provided to NTPC at least 15 days before the proposed early commissioning date. In case there is no response provided by NTPC within 7 days from the receipt of such intimation, such early commissioned capacity shall be deemed to have been rejected by NTPC. In case NTPC does not agree to purchase such energy, early part/full commissioning of the Project shall still be allowed and the SPD will be free to sell such energy to a third party, subject to grant of connectivity and GNA, until SCD or the date of commencement of procurement of power from the Project as notified by NTPC, whichever is earlier. In such cases, a Provisional Commissioning Certificate will be issued to SPD for period up to SCD or date of commencement of Power Procurement (whichever is earlier), along with a NOC for sale of Power to 3rd Party for such period. In such cases a Provisional Commissioning Certificate will be issued to SPD for period up to SCD or date of commencement of Power Procurement (whichever is earlier), along with a NOC for sale of Power to 3rd Party for such period. However, in case the entire capacity is commissioned prior to SCOD, PSPCL may purchase the generation at PPA Tariff.
Early Commissioning. The Power Producer shall be permitted for full commissioning as well as part commissioning of the Project even prior to the SCOD ) subject to availability of transmission connectivity and Long Term Access (LTA). In cases of early part-commissioning, till SCOD, TPL-D shall reserve the right to purchase the generation till SCOD, at 75% (seventy-five per cent) of the tariff as per clause 5.2 of this PPA. However, in case the entire capacity is commissioned prior to SCOD, TPL may purchase the generation at the Tariff as per clause 5.2.
Early Commissioning. (a) The Developer shall be permitted for full as well as part commissioning of the Project even prior to the SCOD.
(b) In case of part commissioning before the SCOD the Procurer shall procure the capacity at 75% (seventy-five per cent) of the AFC pro-rated for the capacity made available for the duration between date of part commissioning and SCOD.
(c) Provided that, for any capacity made available by the Developer before SCOD, Procurer shall have the right but not the obligation to procure such capacity.
(d) In case of early full commissioning of contracted capacity, before the SCOD the Procurer procures the capacity at 100% (hundred per cent) of the AFC for the duration between date of early full commissioning and Scheduled COD. Provided that, for any capacity made available by the Developer before SCOD, Procurer shall have the right but not the obligation to procure such capacity.
(e) In case of early part-commissioning or commissioning of entire capacity prior to the SCOD, and in case the Procurer agrees to procure the early commissioned capacity, the input energy for charging shall be provided by the Procurer at Delivery Point up to the declared Cycle Loss.
(f) Any energy imported by the PHESS during the construction phase i.e., before synchronization shall be on account of Developer.
(g) In cases of early full commissioning, till Scheduled Commissioning Date, MSEDCL may utilize the storage facility at 100% (hundred per cent) of the ESFA rate payable to the ESSD. MSEDCL shall procurer the capacity at 75% of AFC on pro-rata basis for the capacity made available for the duration between date of part commissioning and SCD. However, in case MSEDCL is not willing to avail ESS facility for the period of part commissioning, then ESSD will be allowed to sell power in exchange or through bilateral contacts with permission of MSEDCL. In this case Procurer will not provide Input Energy to Developer. The Developer should share the profit of part commissioned capacity in the proportion of 50:50 (Procurer: Developer).
(h) In case of early part or full commissioning before the SCOD, if Xxxxxxxx doesn’t avail the PHESS facility, Procurer will not provide any Input Energy to Developer and Procurer will not provide Fixed Charges for this period. In this case developer shall allow to sell power to third party. The Developer should share the profit in the proportion of 80:20 (Developer: Procurer).

In case of early part commissioning, the Procurer may purchase the generation at the PPA tariff.
