TEACHER RIGHTS. 3.1 Nothing contained in this agreement shall be construed to deny any teacher, employed by a particular state agency, those rights provided under applicable Nebraska or Federal law. Rights granted to teachers herein shall be deemed to be in addition to those provided above unless said rights are legally modified or amended by this agreement. 3.2 No permanent teacher will be disciplined, reprimanded, have compensation reduced or withheld or be deprived of any professional advantage without just cause pursuant to the Classified System Personnel Rules and Regulations, or in accordance with agency policy and procedure governing discipline. Any suspension of a teacher, pending investigation and disposition of the case, shall be with pay. Such action shall be subject to the grievance procedure herein set forth, and said action may be upheld, modified or reversed (including back pay provisions as required) as a result of said grievance. 3.3 Neither the Employer or its agents nor the Association or its agents will discriminate against any teacher with respect to terms and conditions of employment by reason of their membership in the Association and its affiliates, their participation in collective bargaining, or the institution of a grievance under the terms of this agreement.
