Teachers' Rights of Re-engagement. a. When a position on the teaching staff of the District becomes available, the Board shall, notwithstanding any other provisions of this Agreement, first offer re- engagement to the teacher who has the most seniority among those terminated pursuant to this Agreement, provided that teacher possesses the necessary qualifications for the available position. Acceptance The maintenance of continuing contract status shall not prevent the offer and acceptance of an assignment to a position which is temporarily vacant. h. The Board does shall, by October 15 of each year forward to the Association a list of all teachers employed by the Board, in order of seniority calculated according to Section C, Article C.2.7, setting out the length of seniority as of September 1 of that year.
i. A teacher re-engaged pursuant to this article shall be entitled to all sick leave credit accumulated at the date of termination or completion.
j. A teacher who retains rights of recall pursuant to this article shall be entitled, if otherwise eligible to maintain participation in all benefits provided in this Agreement by payment of the full costs of such benefits to the Board.
k. At the termination of the recall period, a teacher who has not affect been recalled shall retain no rights to employment, preference for employment, recall for employment, or return to employment.
l. A recall list shall be maintained by the Board, and copies of that list will be sent to each person on that list and the Association on September 30 and January 30 of each year.
m. The Board shall send postings of available positions to teachers who are on the recall list. Postings shall be sent to the address last provided by the teacher to the Board. When a teacher's continuing appointment statusteacher is appointed to a position from the recall list, the Association shall receive notification of the appointment.

Unless otherwise agreed, pursuant to Article C.2.11.b, the Board shall arrange to have eligible qualified teachers from the recall list meet in person with the designated Human Resources representative for discussion, consideration and possible offering of appropriate available positions. It is acknowledged that teachers on the recall list are entitled to representation at such meetings. The Board will advise the Association of the scheduling of such meetings to facilitate representation. When a teacher is appointed to a position from the recall list, the Association shall receive notification of the appointment.
12. Severance Pay
a. This subsection is applicable only to teachers who hold continuing appointment positions and is not to be interpreted in any way to apply to teachers who are on a temporary contract.
b. A teacher on continuing appointment who has one (1) or more years of continuous employment and who is terminated pursuant to this Agreement may elect to receive severance pay at any time during the first twelve (12) months where the termination is effective June 30 or during the first eighteen (18) months when the termination is effective December 31.
x. Xxxxxxxxx pay shall be calculated at the rate of five (5) percent of one (1) year’s salary for each year of service with the Board does not affect or portion thereof to a maximum of two (2) years’ salary. Salary on which severance pay is calculated shall be based on the teacher's continuing appointment status’s salary at the time of his/her termination.
d. A teacher who receives severance pay pursuant to this article and who, notwithstanding this Agreement, is subsequently rehired by the Board, shall retain any payment made under the terms of this article, and in such case, for the purposes of Section C, Article C.2.7.c, the calculation of years of service and seniority shall commence with the date of such rehiring.
e. A teacher who elects to receive severance pay under this Agreement shall retain no rights to employment, preference for employment, recall for employment or return to employment.

Teachers' Rights of Re-engagement. a. 5.7.1 When a temporary position on the teaching staff of the District district becomes available, the Board shall, notwithstanding any other provisions of this Agreement, shall inform those on the recall list. The Board shall first offer re- engagement the position to the continuing teacher who has the most seniority among those terminated on the recall list pursuant to this AgreementArticle and who has applied for the posted position, provided that teacher possesses the necessary qualifications for the available position. If that teacher declines the offerWhen positions pursuant to Article E.1 (Posting Vacant Positions) are available, the position Board shall be offered to the teacher with the next greatest seniority and the necessary qualifications and the process shall be repeated until the position is filled. All positions shall be filled in this manner while there are remaining teachers who have been terminated pursuant to this Agreement. A continuing teacher, who is laid off and has accepted a temporary appointment with the Board, shall be returned to inform those on the recall list at the conclusion of the temporary appointment available positions so that they may apply for any positions of their choosing. Teachers on the recall list who apply for posted positions are entitled to be placed in accordance with full rights and seniorityArticle E.2 (Filling Vacant Positions).
b. 5.7.2 Teachers on the recall list will be responsible for advising the office of the Superintendent of Schools, in writing, of any changes in address, telephone number, or qualifications to ensure they are considered for vacancies which might arise. Offers under this Article shall be deemed to be received on the date they are delivered or five (5) days after the date of mailing by priority post, whichever is earlier.
5.7.3 A continuing teacher who is offered re-engagement recall pursuant to Article C.20.3.a of this Agreement C.5.7.2 shall inform the Board whether or not the offer is accepted within forty-eight (48) hours whether or not of the offer is acceptedconfirmed receipt of such offer.
c. 5.7.4 The Board shall allow ten a maximum of thirty (1030) days from an the acceptance of an the offer pursuant to Article C.20.3.b of this Agreement, a continuing appointment for the teacher to commence teaching duties, provided that, where the teacher is required .
5.7.5 A continuing teacher’s right to give a longer period of notice to another employer, such period shall not exceed thirty-one (31) calendar days. A teacher's rights to re-engagement under this Agreement recall is lost ifin the following circumstances:
i. (a) If the teacher elects to receive severance pay pursuant pay;
(b) If twenty-seven (27) calendar months have elapsed from the date of layoff;
(c) Where the loss of the right of recall occurs in which case the teacher's employment shall be deemed to Article C.20.6 of have been terminated. (The teacher's layoff in such circumstances shall be confirmed in writing.)
5.7.6 Continuing teachers on the recall list may be appointed to temporary assignments without jeopardizing their right to recall otherwise contained in this Agreement,
ii. the teacher refuses to accept two (2) different positions of equal or greater percentage of full- time for which the teacher possesses the necessary qualifications. A teacher attending university on a full-time basis or unable to teach due to pregnancy, may reject, without prejudice, an employment offer if the commencement date is inappropriateArticle.
d. Whenever possible, upon re-engagement, 5.7.7 Upon recall a continuing teacher shall be entitled to a continuing appointment to on the teaching staff of the Board district if they the teacher held a continuing appointment at the time of termination, or would otherwise be entitled to a continuing contract pursuant to this Agreement. Acceptance of a temporary position with the Board does not affect a teacher's continuing appointment statuslayoff.

d. A teacher's rights right to re-engagement under this Agreement is lost if:
i. the teacher elects to receive severance pay pursuant to Article C.20.6 C.28.7 of this Agreement,;
ii. the teacher refuses to accept two (2) different positions of equal or greater percentage of full- time for which the teacher possesses the necessary qualificationstime. ii. the teacher refuses to accept two (2) different positions of equal or greater percentage of full- time for which the teacher possesses the necessary qualificationstime. A teacher while attending university on a full-time basis or unable to teach due to pregnancy, may reject, without prejudice, reject an employment offer if the commencement date is inappropriate;
iii. eighteen months elapses from the date of termination under this Article and the teacher has not been re-engaged.
