Tenant’s Warranties and Representations. Tenant represents and warrants to Landlord as follows: (a) Tenant has full right and authority to enter into this Lease and perform Tenant’s obligations under this Lease, and (b) this Lease is and shall be binding upon and enforceable against Tenant in accordance with its terms, and the transaction contemplated hereby will not result in a breach of, or constitute a default or permit acceleration and maturity under any indenture, mortgage, deed of trust, loan agreement or other agreement to which Tenant is subject or by which Tenant is bound.

Tenant’s Warranties and Representations. Tenant hereby covenants that it shall comply with all Federal, State and local laws and regulations concerning Tenant's use, release, storage and disposal of Hazardous Substances on the Premises.

Any liability which may be imposed upon LANDLORD as owner of the Leased Property , which arises out of the presence and/or release of any toxic, hazardous or harmful material, waste, substance or product placed or knowingly permitted to be put or placed on the Leased Property after the effective date of this Lease is hereby specifically assumed by TENANT.
