TERM AND OPTIONS. (a) This Agreement shall be effective and shall continue for the License Period set forth on Schedule B, unless sooner terminated pursuant to a provision of this Agreement.
(b) MLBPA hereby grants to Licensee two (2) separately exercisable options (the "Options") to extend the term of this Agreement for additional one-year periods ("Second and Third License Periods," respectively). In order to exercise each of the two Options, Licensee must provide MLBPA with written notice of its intention to exercise each such Option and such written notice must be received by MLBPA no earlier than one hundred twenty (120) days and no later than ninety (90) days prior to the expiration of the License Period then in effect. The attempted exercise of any Option shall be void and of no effect if Licensee (i) has breached or is then in breach of any of its obligations under this Agreement, or (ii) fails during any License Period to make Net Sales sufficient to generate Actual Royalties equal to or greater than the Guaranteed Minimum Royalties as defined herein, or (iii) fails to make full and timely royalty payments as provided herein. Licensee's performance in each License Period shall be pursuant to the same terms and conditions recited in this Agreement.

TERM AND OPTIONS. TO HAVE AND TO HOLD said premises and the appurtenances thereto unto LESSEE for and during a primary lease term of ten (10) years commencing on the first day of the month following the "Rent Commencement Date", as that term is hereinafter defined, and ending at midnight on the last day of said ten (10) year term ("Primary Term"). Notwithstanding the foregoing to the contrary, if the Rent Commencement Date shall fall on the first day of the month, then the lease term shall commence on such same date. Following the determination of said Rent Commencement Date and said Primary Term and Renewal Term commencement and expiration dates, the parties hereto shall (upon request by either party) execute a written acknowledgment thereof.
TERM AND OPTIONS. 3.1. The Initial Period of this Agreement shall be a period commencing on the date of this Agreement and ending ninety (90) days after the release of the Minimum Commitment in the UK.
3.2. The Artist hereby grants to Company three (3) separate consecutive options to extend the Term for further periods commencing upon the expiry of the then current Contract Period and expiring twelve (12) months after such commencement or if later three (3) months after the delivery of the Minimum Commitment for such Contract Period (the "First Option Period", "Second Option Period" and "Third Option Period" respectively and collectively referred to as the "Option Periods") provided that no Contract Period shall in any event last for more than two (2) years.
3.3. Each option referred to in clause 3.2 above shall be exercised by Company serving upon the Artist written notice at any time prior to the expiry of the then current Contract Period. Notwithstanding any of the foregoing if at the date when the then current Contract Period would otherwise have expired Company has neither exercised its option to extend the Term for a further period nor notified the Artist that it does not wish to exercise such option then the following provisions shall apply:
3.3.1. The Artist shall forthwith notify Company in writing that its option has not yet been exercised ("an Option Warning")
3.3.2. Company shall be entitled to exercise its option to extend the Term for a further period as set out above at any time before receiving the Option Warning or within five (5) business days thereafter.
3.3.3. The then current Contract Period shall be deemed to have continued until Company either exercises its option or gives notice to the Artist that it does not wish to exercise its option or until the end of such period of five (5) business days (whichever shall first occur) provided always that in the event that Company exercises its option to extend the Term then the commencement date of the relevant Contract Period shall be deemed to be the date such Contract Period would have commenced had Company exercised its option in a timely fashion without regard for the provisions of this clause.

1.2 Subject to the conditions herein, Lessee shall have the option to extend the term of this Agreement for two additional periods of five years each, hereinafter the "Extended Term(s)," provided that at the time of such exercise and at all times before any Extended Term, Lessee is not in default in the payment of any rent or in default in any other provisions of this Agreement. TERM AND OPTIONS. 3.1. The Term of the Lease for the entire Leased Premises shall be extended for thirty-six (36) months (the “Extended Term”) from the Added Premises Commencement Date.
