Common use of Termination of Seniority and Employment Clause in Contracts

Termination of Seniority and Employment. An employee's seniority shall be terminated if the employee resigns or is discharged for just cause. An employee's seniority and employment shall be terminated automatically if the employee A. fails to report to work within the prescribed time limits after leave of absence or layoff, B. retires, C. engages in gainful employment during a leave of absence (except a leave expressly granted for such purpose), D. is absent for three (3) consecutive work days without approval of the University, which approval shall not be unreasonably withheld, E. is laid off for the period of time as follows: a. for employees with less than two (2) years of continuous service with the University eighteen (18) months, b. for employees with more than two years but less than ten years continuous employment with the University twenty-four (24) months, c. for employees with more than ten (10) years but less than twenty (20) years continuous employment with the University thirty (30) months, d. for employees with more than twenty (20) years of continuous service with the University thirty-six (36) months.
