Third Party Use – Approval. The Authority hereby agrees with the Company that where the Company reasonably believes that Third Party Use is not compatible with the use of the Academy for a school, the Authority shall at the request of the Company exercise its powers to regulate the use of the Academy under the terms of Clause [ ] of the Project Agreement.

Third Party Use – Approval. The Authority hereby agrees with the Governing Body that where the Governing Body reasonably believes that such use is not compatible with the use of the Sites for schools, the Authority shall exercise its powers to regulate the use of the School under the terms of Clause 29 of the Project Agreement. Control19 The Governing Body transfers control of the use of the School at all times outside the Required Period20 (the Required Period being the School Days and Additional School Periods under the Project Agreement) to the Authority and the Contractor to the extent contemplated by the Project Documents but no further. School Standards and Framework Act 1998 The matters contained in Section 40 and Schedule 13 to the School Standards and Framework Act 1998 are hereby incorporated into this Agreement and form part of it.   • FAA APPROVAL This Agreement may be subject to approval of the FAA. If the FAA disapproves this Agreement, it will become null and void, and both Parties will bear their own expenses relative to this Agreement, up to the date of disapproval.

  • State Approval of Replacement Personnel The Engineer may not replace the project manager or key personnel without prior consent of the State. The State must be satisfied that the new project manager or other key personnel is qualified to provide the authorized services. If the State determines that the new project manager or key personnel is not acceptable, the Engineer may not use that person in that capacity and shall replace him or her with one satisfactory to the State within forty-five (45) days.

  • Regulatory Approval 25.1 The Parties understand and agree that this Agreement and any amendment or modification hereto will be filed with the Commission for approval in accordance with Section 252 of the Act and may thereafter be filed with the FCC. The Parties believe in good faith and agree that the services to be provided under this Agreement are in the public interest. Each Party covenants and agrees to fully support approval of this Agreement by the Commission or the FCC under Section 252 of the Act without modification.

  • Course Approval Approval for dual credit shall be by the LEA and POSTSECONDARY INSTITUTION representatives on a course-by-course basis each semester based on the student’s prior coursework, career pathway, and/or academic readiness. There is no state limit to the number of credits a student may earn through dual credit in an academic term; however, the student must meet eligibility requirements.

  • AGREEMENT APPROVAL This agreement constitutes the entire agreement between the parties and supersedes any previously executed agreements, representations, verbal or written, to buy and/or sell the property. Neither this agreement, nor any interest herein, shall be transferred or assigned by Buyer without the prior written consent of Seller.
