Common use of Time bar Clause in Contracts

Time bar. If a Party does not give a Dispute Notice under clause 8.1(a) in respect of a Dispute within 12 Months after the date it becomes aware or ought reasonably to have become aware of the occurrence of the event or circumstance giving rise to the Dispute: (a) the Party must not give the other Parties such a Dispute Notice; (b) any such Dispute Notice which is given by the Party will be taken to be of no effect; and (c) the Party will not have, and must not make, any Claim against the other Parties in respect of the Dispute.
