TOIL ENTITLEMENTS. 16.1 An employee who accrues time off in lieu (TOIL) of overtime in accordance with the applicable Award cannot lose that entitlement. 16.2 Where an employee accrues TOIL, that is to be taken as follows: 16.2.1 At a time agreed with the employer within 3 months of accrual; or 16.2.2 With the agreement of the employer, may accrue up to 5 days TOIL in a financial year before being subject to a direction to take the time; or 16.2.3 At a time directed by the employer where the employee has not taken the time within 3 months of accrual or would otherwise carry forward to the next financial year more than 5 days TOIL.
